The suspect was initially suspected of violating Article 362 in conjunction with Article 367 Paragraph (2) of the Criminal Code in conjunction with Article 65 Paragraph (1) of the Criminal Code regarding theft.

Previously, the suspect was known to have stolen a compressor belonging to the victim Nyoman Puspanda, then in October 2021 the suspect took a Polytron 32 LED TV unit installed in the victim's room and in November 2021 the suspect took a Toshiba 29 Tube TV unit in the room. victim's guest.

Due to the suspect's actions, the victim suffered a loss of Rp. 9 million.

"The suspect's motive was to steal to sell, where the proceeds from the sale of these items were used by the suspect for personal purposes," said Gede Astawa.

Meanwhile, the reason for giving the termination of prosecution based on restorative justice is given because the suspect has committed a crime for the first time and the article whose alleged crime is punishable by no more than five years.

"The suspect and victim have a family relationship between their grandson and biological grandfather. There has been a peace agreement between the suspect and the victim on December 29, 2021 and January 18, 2022, after the case was handled by the Buleleng Kejari after phase II," he explained.

Meanwhile for the evidence that was confiscated so that it can be returned to the victim and the situation can be restored to its original state. However, if the case is continued, it is feared that it will lead to strained relations between the suspect and the victim.

"The suspect committed the act due to miscommunication due to a lack of parental love, the suspect's father died when the suspect was two years old and his mother left him to return to his original home since the first grade of elementary school," he said.

"After the RJ process is complete the suspect will stay with his uncle in Denpasar so that the suspect does not return to the same association so that he does not repeat his actions again," he said.

In addition, his party will also issue a Decision on Termination of Prosecution (SKP2) based on restorative justice as a manifestation of legal certainty, based on the Attorney General's Regulation Number 15 of 2020 concerning termination of prosecution based on restorative justice.
