Finalize Investigation Of Garuda Indonesia Corruption Allegations, Attorney General's Office Coordinates With BPKP

JAKARTA - The Attorney General's Office is coordinating with the Financial and Development Supervisory Agency (BPKP) to finalize the investigation into the alleged corruption case at PT Garuda Indonesia (Persero).

The Director of Investigations of the Deputy Attorney General for Special Crimes (JAMPidsus) at the Attorney General's Office, Supardi, said that he was coordinating with BPKP to audit the investigation of state financial losses caused by leasing the ATR 72-600 aircraft.

"In order to ripen it. How much is the loss, the assumption is there is a loss or not, we'll make sure of that. Then to rent or buy any plane, so it's like that. Finalize it later in the context of calculating state financial losses," Supardi said when confirmed in Jakarta, reported by Antara, Tuesday, January 18.

According to Supardi, the meeting and coordination with BPKP for the audit of the financial investigation is scheduled for Tuesday, January 18.

The coordination, said Supardi, is still in the investigation stage. After that coordination, the investigators of the Roundhouse will expose the case, whether the case can go up for investigation or not.

"Not yet (investigation), but this is in the context of an investigation. Initiate an investigation, as much as possible later to the investigation, if possible, "said Supardi.

Supardi said that his party still needs to coordinate with BPKP. Because the results of the BPKP audit were submitted by SOE Minister Erick Thohir, Tuesday, January 11.

According to Supardi, the data provided by SOE Minister Erick Thohir is only the result of an audit for one procurement. "Not enough, it's only one procurement," said Supardi.

The alleged corruption case of PT Garuda Indonesia occurred during the leadership of Emirsyah Satar, who was convicted of corruption in the procurement of jet engines.

Regarding this, Supardi said that his party had coordinated with the Corruption Eradication Commission (KPK) and had received several documents, as well as documentary evidence which was used as evidence by the KPK in handling cases involving Emirsyah Satar.

According to Supardi, the abundance of documentary evidence or evidence in the form of a copy of the document from the Corruption Eradication Commission (KPK) can be supporting evidence and main evidence in the alleged corruption case handled by his party.

"Already (coordination). And today we have received several documents, evidence of documents that used to be copies of documents that were used as evidence or proof of letters handled there (KPK)," said Supardi.

As previously reported, the Junior Attorney General's Investigator for Special Crimes has started an investigation into the alleged corruption case at Garuda since November 15, 2021, with the issuance of an Investigation Order Number Print-25/Fd.1/2021.

The alleged corruption of inflating the rental price for the procurement of the ATR 72-600 aircraft occurred during the leadership of Garuda Indonesia President Director Emirsyah Satar (ES) who is currently being detained in connection with the alleged bribery case for the procurement of aircraft and aircraft engines from Airbus SAS and Rolls-Royce at PT Garuda Indonesia.

A number of parties have been examined, including Emirsyah Satar, but until now investigators have not raised the status of the case to investigation.

As for the position of the case based on the Company's Long-Term Plan (RJPP) for 2009-2014, Garuda plans to procure an additional fleet of 64 aircraft using either a purchase (financial lease) or lease (operational lease buyback) scheme through a lessor or companies that provide services for renting out goods in the form of business use.

In this case, the addition of the fleet uses a lessor agreement, in which a third party provides funds and Garuda pays it to the lessor. Payments are made in stages by taking into account the delivery time against inflation.

The realization of the RJPP is in the form of procuring 50 ATR 72-600 aircraft, which consists of purchasing 5 aircraft and leasing 45 aircraft. Meanwhile, for the procurement of 18 units of CRJ 1000, 12 of them are leased.

The President Director of Garuda formed an aircraft rental procurement team in the business plan procedures related to the aircraft procurement. The team consisting of the Technical Directorate, the Commercial Directorate, the Operations Directorate, and the Service/Commerce Directorate conducted a study and put it in the form of a study paper.

For the procurement or lease of the aircraft, it is suspected that a criminal event has occurred which has caused state losses and has benefited the lessor.

Regarding this case, Minister of State-Owned Enterprises (BUMN) Erick Thohir met with Attorney General Sanitiar Burhanuddin, Tuesday, January 11, to submit data and audit results from BPKP. This data is to complete the investigation process carried out by JAMPidsus.
