PKB Proposes Articles Of Forced Abortion To Be Re-included In The TPKS Bill

JAKARTA - Member of the Legislative Body (Baleg) of the DPR from the PKB faction, Luluk Nur Hamidah, proposed to the working committee (panja) of the Draft Law on the Crime of Sexual Violence (RUU TPKS) to re-insert the article on forced abortion. Previously, the article was removed from the draft TPKS Bill.

Luluk does not want the case of a student with the initials NW who became a victim of forced abortion and ended up committing suicide again.

"We know that there is a woman who is a victim of forced abortion, so this reminds us of our debate at the beginning that it is necessary that the article on forced abortion should be abolished in this bill. Even though the reason at that time (the article on forced abortion, ed) was harmonized with the law existing laws," Luluk said at the DPR Baleg meeting at the DPR building, Jakarta, Wednesday, December 8.

According to him, the current law has not accommodated the article on forced abortion. Even though it is in the Criminal Code (KUHP), Luluk said, there is no detailed explanation yet.

"Even in the draft of the Criminal Code, which I read yesterday to be able to see whether forced abortion is actually already in the RKUHP, it turns out (I, ed) also don't see that spirit listed there," said Luluk.

Luluk then read out the sentence that he proposed to be used as an article on forced abortion, namely "Everyone who terminates a woman's pregnancy with violence, threats of violence, threats of violence, abuse of power, misdirection, fraud, powerlessness or without consent shall be punished for forced abortion with imprisonment. a maximum of 12 years and may be subject to additional penalties in the form of payment of restitution and corrective actions.

Luluk hopes that the addition can be listed before the TPKS Bill is plenary this afternoon. "Because of the incident experienced by NW, a female student at a campus with a national reputation, forced abortion is something real. It was not fabricated," he said.

For information, the plenary meeting of the TPKS Bill was originally scheduled to be held at 14.00 WIB to determine whether the TPKS Bill could be brought to a plenary meeting as the DPR's initiative right or again and it failed and could not be passed into law.
