Rejecting Khofifah's Decision Regarding The 2022 UMK, Apindo East Java Considers Taking The Legal Route
SURABAYA - Entrepreneurs who are members of the East Java Indonesian Employers' Association (Apindo) plan to take legal action related to the East Java Governor's decision regarding the 2022 Regency/City Minimum Wage (UMK) determination.
"Since it has become a legal product, in the future Apindo East Java will consider taking legal action on the Decree number 188/803/KPTS/013/2021 issued by the East Java Governor regarding the 2022 UMK", said Deputy Coordinator of Wage for Apindo East Java, Johnson Simanjuntak, confirmed, Wednesday, December 1st.
Johnson assessed that Khofifah's decision did not have legal certainty, because the formulation of the UMK value, especially in the five-ring regions of East Java, was determined not to be by Government Regulation number 36 of 2021 concerning Wages.
According to Johnson, the decision will have an impact not only in terms of wages for workers but also in the investment and other business sectors, because the process of determining wages for workers is no longer by existing regulations, namely Government Regulation (PP) 36 of 2021 concerning wages.
"We don't know what formulation the Governor of East Java uses, so the increase is not by PP 36 of 2021. We consider this to have no legal certainty", he said.
As is known, the UMK in 2022 in 5 rings 1 areas of East Java will increase by IDR 75,000 each. One of the reasons for this increase is because the five-ring regions of East Java are in a densely industrialized area.
The five areas of ring one are Surabaya, Gresik, Mojokerto, Sidoarjo and Pasuruan.
Meanwhile, 33 other regions calculate the latest UMK based on the formulation according to Government Regulation number 36 of 2021.
