JAKARTA - Deputy Chairperson of the MPR Arsul Sani assessed that the Constitutional Court's (MK) formal review decision on Law Number 11 of 2020 concerning Job Creation (UU Cipta Kerja) which was declared unconstitutional would create new problems.

"Is it true that the Constitutional Court's decision will be a decision that solves the problem without problems, or a decision that can or has the potential to cause new problems. Arsul explained that there were two cases in the review of the Job Creation Law, namely the material test and the formal test. The Constitutional Court's decision is a formal test. He predicts that new problems will arise due to dissatisfaction with the results of the judicial review if the government and the DPR have revised the Job Creation Law.

"Because if the government and the DPR have corrected it, then the results of the improvement are materially dissatisfied with elements of this citizen, this will be tested again materially," explained Arsul. a formal test related to the Job Creation Law so that improvements can be made only once. "In my opinion, the Court should decide it at once. Both the formal and material tests, not individually. So that the legislators, even if they have to fix it, even have to change the law.
