After Knowing That The Job Creation Law Was Declared Unconstitutional, Jokowi Asked His Ministers To Carry Out The Constitutional Court's Decision
JAKARTA - President Joko Widodo has ensured that the government will implement the decision of the Constitutional Court (MK) regarding the unconstitutional Law Number 11 of 2020 concerning Job Creation (omnibus law).
In fact, the President has ordered his subordinates to carry out this decision. Because, the decision of the Constitutional Court is final and binding.
"I have ordered the coordinating ministers and related ministers to immediately follow up on the Constitutional Court's decision as soon as possible," Jokowi said at the Palace, Monday, November 29.
The Constitutional Court ruled that the job creation law was unconstitutional because it was formally flawed because the discussion process did not comply with the rules and did not meet the element of openness.
The constitutional judges agreed that the method of merging or the omnibus law in the Job Creation Act was not clear whether it was the making of a new law or a revision.
In addition, this law is considered not to hold the principle of openness to the public even though it has held several meetings with several parties in the process of its formation.
The reason is that the meeting is considered not to have reached the stage of the substance of the law. Likewise, the draft Law on Job Creation is also considered by the Court to be not easily accessible to the public.
Based on this decision, in the future, the government and the DPR will make improvements such as the Constitutional Court's decision. In its decision, the Constitutional Court stated that the Job Creation Law was still in effect.
"The government and the DPR as lawmakers are given a maximum of two years to make revisions or improvements. Thus, all regulations on the Job Creation Law are still valid," said Jokowi.

Jokowi asked business actors and investors not to be upset by this decision. Jokowi shuts down investments that have been, are running, and will run safely. This is because the Constitutional Court in its decision stated that the Job Creation Act is still in effect.
"I make sure that investments that have taken place and are or will take place are safe," said Jokowi.
Jokowi said, with the decision, all the materials and substances in the Job Creation Act are still valid. Jokowi emphasized that no article was declared invalid.
"Once again, I make sure that the government guarantees the security and certainty of investment in Indonesia," he concluded.
