KPK Prosecutor Demands 2 Defendants Of Bribery For Procurement Of CCTV Bandung Smart City For 2.5 Years In Prison

BANDUNG - The KPK Public Prosecutor (JPU) charged two defendants with bribery for the procurement of CCTV Bandung Smart City with a criminal sentence of 2.5 years. The two defendants were referred to as Director of PT Sarana Mitra Adiguna (SMA) Benny and Manager of PT SMA Andreas Guntoro.

The prosecutor revealed that he was proven to have committed bribes in the form of money and facilities to Thailand to a number of officials in the city of Bandung, including the inactive Bandung Mayor Yana Mulyana, worth IDR 585 million so that he could get a CCTV procurement project in the city of Bandung.

"We, the public prosecutor, demand that the Bandung District Court Corruption Court Judges who examine and try this case, one declares that the defendant one Benny and the two defendant Andreas Guntoro are proven legally and convincingly guilty of committing a criminal act of corruption together and continuing," said KPK Prosecutor Tito Jaelani at the Bandung District Court, Wednesday, August 23, confiscated by Antara.

Based on the facts and evidence presented at the trial, the prosecutor asked the panel of judges to sentence each defendant to 2.5 years and a fine of Rp. 100 million, subsidiary to six months in prison.

"The defendants were sentenced to two years and six months in prison and a fine of Rp. 100 million each with a subsidiary of six months minus the detention period that the defendants had served," he said in reading his demands.

Tito said the aggravating considerations for the defendant were not supporting the corruption eradication program, while the mitigating ones had never been convicted, pleaded guilty, polite, and respected the trial.

They were both charged with the first alternative indictment, namely Article 5 paragraph 1 letter a or Article 13 of the Corruption Eradication Law in conjunction with Article 64 paragraph 1 of the Criminal Code.

After the trial, Tito said the total bribes given by the defendants to officials in Bandung, including the inactive Bandung Mayor Yana Mulyana, Bandung City Transportation Head Dadang Darmawan and Bandung City Secretary Khairur Rijal, were around Rp585 million.

The money was given, one of which was as a facility during the visit of these officials to Thailand without permission which they admitted to inspect the Huwawei CCTV.

The demand for punishment for Benny and Andreas is higher than other defendants Director of PT CIFO Sonny Setiadi in a bribery case related to the procurement of an internet network which was charged with two years in prison and a fine of Rp. 100 million, subsidiary to six months in prison.

The defendant Sonny Setiadi, called the KPK prosecutor, was proven to have given bribes to officials in the city of Bandung, including Yana Mulyana, amounting to Rp. 186 million.
