Bawaslu Gives Reprimand Sanctions To The East Kalimantan KPU Regarding The Addition Of Garuda Party Candidates

The Election Supervisory Agency (Bawaslu) has imposed a warning to the General Election Commission (KPU) of East Kalimantan (Kaltim) regarding the addition of prospective members of the East Kalimantan DPRD from the Garuda Party during the period of improving candidacy through the nomination information system (Silon) application.

"Give a warning to the reported party (KPU Kaltim) not to repeat or commit acts that violate statutory provisions," said member of the Indonesian Bawaslu Puadi as the presiding judge in the trial reading the verdict on case number 001/TM/ADM.PL/BWSL/00.00/VI/2023 in the Bawaslu Court Room, Jakarta, reported by ANTARA, Wednesday, July 5.

Puadi also said that the East Kalimantan KPU as the reported party was legally and convincingly proven to have violated the election administration related to the addition of 24 candidates for members of the East Kalimantan DPRD submitted by the Garuda Kaltim Party from 28 people to 52 people during the period of improving their candidacy in Silon.

The case began with a number of political parties participating in the 2024 General Election which experienced technical problems in accessing the Silon application when uploading the submission documents for prospective candidates for provincial DPRD and district/city DPRD members.

Based on the Indonesian KPU Letter Number 495 / PL.01.4-SD / 05/2023 regarding the re-submission of candidates for provincial DPRD and district / city DPRD members due to Silon constraints, a number of political parties participating in the 2024 General Election, such as the Garuda East Kalimantan Party, were given the opportunity to improve the nomination documents for members of the provincial DPRD.

During the repair period, the East Kalimantan Bawaslu as the reporting party found that the Garuda Kaltim Party had added candidates for members of the East Kalimantan Provincial DPRD.

Previously, the Garuda East Kalimantan Party on May 14, 2023 at 21:52 WITA proposed as many as 28 candidates spread across six electoral districts (dapil) in East Kalimantan. After examining the documents for submitting candidates to the candidate, the East Kalimantan KPU stated that it would receive 28 candidates on May 15, 2023 at 06.35 WITA.

After being declared accepted, the Garuda Party is obliged to upload a document on the requirements for submitting a list of candidates and administrative requirements for candidates for a maximum of 2 X 24 hours into the Silon.

However, he said, the required documents could not be submitted through Silon due to technical problems. With the Indonesian KPU Letter Number 495 / PL.01.4-SD / 05/2023, the Garuda Kaltim Party had the opportunity to correct the submission of their candidate candidates for 5 X 24 hours.

Next on May 19, 2023, the East Kalimantan KPU received and examined the submission of candidates for provincial DPRD members from the Garuda Party. Then, they stated that as many as 52 prospective members of the East Kalimantan DPRD from the Garuda Party could be accepted.

According to Bawaslu, during this period of improvement, the Garuda Party can only submit a list of prospective members of the East Kalimantan DPRD who have been submitted in the period of submitting the list of candidates that have been determined by the KPU in KPU Regulation (PKPU) Number 3 of 2022 concerning the stages and schedule for holding the 2024 General Election, namely 1 14 May 2023.

"Not adding that there will be new candidates outside that proposed during that time," said member of the Indonesian Bawaslu Totok Hariyono as member judge.

Thus, Totok conveyed that his party assessed that the addition of new candidates from the Garuda East Kalimantan Party outside the period 1 14 May 2023 was not in accordance with the procedures, procedures, or mechanisms regulated in the laws and regulations.

He conveyed that Article 247 paragraph (2) of Law Number 7 of 2017 concerning Elections stated that the list of candidates for DPR members, provincial DPRD, and district/city DPRDs was submitted no later than nine months before the voting day.

"This makes it clear that if the 2024 election vote is held on February 14, 2024, if it is withdrawn for nine months, then the deadline is May 14, 2023," he said.

Thus, Bawaslu concluded that the actions of the East Kalimantan KPU in submitting prospective members of the East Kalimantan DPRD from the Garuda Party were not in accordance with the procedures, procedures, and mechanisms that had been regulated in the provisions of the legislation.
