The Government Guarantees That The Rights Of Ulayat Land Are Not Lost After Being Certified

PADANG - The government through the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency ATR/BPN guarantees that the customary land rights of indigenous peoples in the country will not be lost after being registered or certified.

"It will not be lost if it is immediately registered or certified," said ATR/BPN Minister Marshal TNI (Ret.) Hadi Tjahjanto in Padang as reported by ANTARA, Tuesday, June 20.

This affirmation was conveyed by Minister Hadi regarding the existence of a legal community who were worried that their customary legal customary land would switch to other parties after being registered or certified.

Hadi emphasized that the Ministry of ATR/BPN is only tasked with transferring physical soil data and juridical aspects to land books and measuring letters.

If the customary legal customary land has been registered or obtained a certificate, the people who are in the scope of the land only have to regulate the provisions without having to lose their rights.

During his working visit to West Sumatra, the former TNI Commander revealed that the area of customary land for indigenous legal communities in West Sumatra Province reached 352,000 hectares (Ha).

Hadi said that customary legal community land that has been registered and obtained certificates will provide legal benefits and certainty, one of which is that the area of land will not continue to decrease.

"After we register there will be no more overlapping, there will be no more problems that want to take the land," he asserted.

In order to solve various problems of customary land in the country, the Ministry of ATR/BPN will first map out which land is under the authority of the Ministry of Environment and Forestry (KLHK), belonging to the indigenous law community, land occupied by other agencies by pocketing certificates, including determining areas commensurate with rivers or roads.

"After we issue the certificate and put it into the spatial layout, we will see which areas are customary and which are other areas," he said.
