Waiting For The Results Of The Joint Agreement On Crowd Permits And Song Royalties

JAKARTA - The Ministry of Law and Human Rights (Kemenkumham) is currently discussing a joint agreement with the Ministry of Tourism and Creative Economy (Kemenparekraf), the Ministry of Youth and Sports (Kemenpora), and the Indonesian Police regarding crowd permits and licenses for the use of songs through royalty payments from event organizers.

"We are currently discussing with the Ministry of Tourism and Creative Economy, the National Police, and the Ministry of Youth and Sports to produce a kind of mutual agreement to ensure that each event organizer pays royalties before obtaining crowd permits from the police or the party authorized to issue the permit," said Director of Copyright and Industrial Design of the Ministry of Law and Human Rights Anggoro Dasananto in the Graha Utama room of the Ministry of Education, Culture, Research and Technology (Kemendikbudristek) Jakarta, Monday, quoted by Antara.

Anggoro said that through the agreement, the authorities would not issue a crowd permit before the event organizers (EO) first carried out an obligation in the form of paying royalties to the National Collective Management Institute (LMKN) regarding the songs to be featured in an event.

"All permits other than through applications that have been prepared by LMKN, there must be a recommendation from the Police that the person concerned has paid royalties. It is not implemented simultaneously, but gradually because it is adjusted to the condition of the community. In essence, obey royalty payments are not for the government, LMKN, or any ministry, but for creators, music art actors and so on," said Anggoro.

He continued that the willingness of every party who is obliged to pay for the use of the work is an effort so that economic rights can be obtained properly. Every party that uses the work of others, Anggoro continued, also deserves to respect the copyright at the same time fulfills the obligation to pay for its use if it is commercialized.

"Form a joint agreement with ministries and the National Police for the time being, it may be a kind of joint decree. What kind of mechanism will be, of course, very dynamic in the discussion and will be made into a decision which essentially urges every EO to pay," concluded Anggoro.
