Sentenced To 9 Years In Prison In Saprodi Corruption Case With Rice Field Prints, Former Head Of Bima Regency Files Cassation

NTB - The defendant in the corruption program for distributing aid for production and printing of new rice fields for the 2016 fiscal year, M. Tayeb, filed an appeal against the judge's verdict at the appeal level.

Tayeb, who is the former Head of the Bima Regency Agriculture, Food Crops and Horticulture (Kadistan), did not accept the judge's sentence of 9 years in prison against him.

"Yes, for the appeal on behalf of the defendant M. Tayeb, he only entered today at the Mataram District Court, because the person concerned submitted through his legal advisor," said Mataram District Court (PN) spokesman Kelik Trimargo in Mataram, West Nusa Tenggara (NTB), Wednesday, August 23, confiscated by Antara.

Kelik explained that in the future the court would notify the public prosecutor (JPU) regarding the submission of an appeal from the defendant M. Tayeb.

"After that, the court will wait for counter-cassation memory and the public prosecutor. If it has been received, the cassation files are all complete, then we can send them to the Supreme Court," he said.

The legal adviser to the defendant M. Tayeb, Aan Ramadhan, confirmed the appeal to the Mataram District Court.

"Yes, we as legal counsel represent our client and have just declared today's appeal to the court," said Aan.

By conveying this, Aan said that his party is currently preparing a memorandum of cassation file. All submission considerations will be submitted in the completeness of the file.

The panel of judges at the appeal level in the decision, Wednesday, August 2, stated that the defendant M. Tayeb had been proven to have violated the primary indictment of the public prosecutor regarding Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code.

With these criminal rules, the judge determined that the defendant M. Tayeb's actions as head of the service were proven to be against the law by imposing a sentence of 9 years in prison and a fine of Rp. 400 million, subsidiary to 6 months in prison.

Against the defendant, the judge also imposed an additional penalty in the form of paying compensation for state losses of Rp. 2.5 billion, subsidiary to 1 year in prison.

The judge also determined that the defendant's deposit from the public prosecutor worth Rp. 12.5 million was confiscated by the state to cover some of the state's compensation money.

The judge made this decision by canceling the decision of the Corruption Court at the Mataram District Court for the case M. Tayeb with the number: 2/Pid.Sus-TPK/2023/PN Mtr.

The implementation of the 2016 program cost IDR 14.4 billion. The budget comes from the Indonesian Ministry of Agriculture. This program is distributed with the aim of increasing food production in Bima Regency.
