Proven Corruption, Former Director Of Praya Hospital Sentenced To 6 Years In Prison
MATARAM - The panel of judges sentenced Muzakir Langkir, the former Director of the Praya Regional General Hospital, Central Lombok Regency, West Nusa Tenggara, to a corruption case in the management of funds from the regional public service agency (BLUD) in the 2017-2020 fiscal year.
"The defendant Muzakir Langkir was sentenced to 6 years in prison and a fine of IDR 500 million, subsidiary to 6 months in prison," said Chief Judge Mukhlassuddin reading the verdict of the defendant Muzakir Langkir at the Mataram Corruption Court, reported by ANTARA, Tuesday, July 11.
The judge also sentenced the defendant to an additional criminal sentence to pay compensation for state losses of IDR 883 million, subsidiary to 1.5 years in prison.
In the decision, Mukhlassuddin as chairman of the assembly made dissenting opinions or opinions different from members of the assembly. The difference of opinion in the decision relates to the application of the article.
Mukhlassuddin stated that the defendant Muzakir Langkir's actions were proven to have violated Article 3 and Article 12 letter ejuncto Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code.
He said the defendant as the power user of the budget in managing BLUD funds at the Praya Hospital had been proven jointly with two other defendants, namely Baiq Prapningdiah and Adi Sasmita, who abused their authority, causing state losses.
The opinions of two member judges, Kadek Dedy Arcana and Djoko Soepriyono, stated that the defendant's actions violated Article 2 paragraph (1) and Article 12 letter e jo. Article 18 of Law Number 31 of 1999 as amended by Law no. 20 of 2001 jo Article 55 paragraph (1) 1st of the Criminal Code.

The two member judges applied the article by stating that the defendant's actions together with the other two defendants had been proven to be against the law by enriching themselves, others, and/or a corporation.
The judge in making the decision also conveyed the refund of money from a number of partners implementing the BLUD project with a value of at least IDR 300 million to be confiscated by the state.
Regarding the return of state losses by the defendant worth IDR 50 million and four land ownership certificates (SHM) in the Central Lombok area on behalf of Muzakir Langkir, he was asked to be confiscated and auctioned off to be used as an additional payment for compensation for state losses.
