The family of former Kostrad Commander Lt. Gen. (Ret.) Kemal Idris won a inheritance house lawsuit at the South Jakarta District Court (PN). The lawsuit was filed by two children of the 2nd Presidential-era general Suharto, Firrouz Muzzaffar Idris and Anggreswari Ratna Kemawati.

They sued after the inheritance house in the Pondok Pinang area, South Jakarta with an area of 1,061 square meters was controlled by another party even though there was no agreement.

The defendants were Notary RA Mahyasari, Rio Febrian, PT CAI, Firly Amalia who were also defendants, and Head of the South Jakarta ATR/BPN Office.

"Granted the plaintiffs' claims in part," said Chief Justice Muhammad Ramdes at the South Jakarta District Court, Monday, July 24.

The judge assessed Mahyasari's actions in making the PPJB Deed Number: 06 dated November 6, 2017; Deed of Power Sells Number: 07 dated November 6, 2017; and Deed of Exemption Number: 08 dated November 6, 2017 on Certificate of Ownership of Dispute Objects owned by Firrouz and Anggreswari is an act against the law. Thus, he was asked to return the certificate which was controlled.

"Declaring that the defendant I's actions that have stored and have not returned the Certificate of Ownership of the dispute belonging to the Plaintiffs are unlawful acts," said the judge.

Not only that, the South Jakarta District Court Panel of Judges also considered Rio's actions as a defendant who deliberately ordered to hand over the certificate and arrange the signing of the deed as an unlawful act. Likewise with PT CPI which has signed various deed related to ownership of dispute objects.

In addition, the deed that had been issued by Mahyasari was considered invalid. Thus, the heritage house was requested to be returned immediately.

"If necessary with the help of law enforcement officers," said the judge in the trial.

If the object in the form of a house is not handed over immediately, the certificate is declared missing. Thus, Firrouz and Anggreswari can take care of it again at the South Jakarta BPN Office.

The defendant now has 14 days to appeal. Meanwhile, Anggreswari Ratna Kemalawati said she was satisfied and hoped that the decision would immediately have permanent legal force.

"I'm happy with this decision, because it belongs to my family," said Anggreswari accompanied by his lawyers, Yayan Riyanto and Veridiano LF Bili.
