Buru Police Name 5 Suspects In The Case Of The Fall Of Container B3 At Namlea Port

The Buru Island Police held a press conference regarding the case of the fall of containers containing B3 that occurred at Namlea Port, in Namlea, Buru Regency, Maluku Province, Thursday (13/7/2023). BETWEEN/HO-Polda Maluku.

The Buru Resort Police have named five suspects in the case of falling containers containing chemicals, toxic and dangerous (B3) which are suspected to be illegal, when loading and unloading from the KM Doloronda ship, at Namlea Port, Buru Regency, Maluku.

Head of Public Relations of the Maluku Police, Kombes M. Roem Ohoirat, said the five suspects had the initials HW alias Aris alias Puang Aris, as the owner of B3 evidence in the container number GVCU210168-2 measuring 20 feet (18).

Furthermore, R alias Ridho, and F alias Fadli, as the expedition party responsible for shipping containers containing B3, and HG alias Anto (as the person who ordered the container blockcrane operation containing B3 while loading and unloading on the KM ship. Dorolinda), as well as HK alias Harun (as the person who operates blockcrane to lower containers containing B3, which due to negligence caused containers containing B3 to fall into the sea).

"The modus operandi carried out is that the owner of the goods includes B3 which is prohibited according to the law into the territory of the Unitary State of the Republic of Indonesia," said Roem Ohoirat as quoted by ANTARA, Thursday, July 13.

The suspects tricked the officers by packing the B3 in the form of a packaging of flour sacks, and in the registered shipping manifest it was mixed goods, not B3 goods, and this was known by the sender (expedition).

On the other hand, he said, the fall of containers was also suspected to be due to negligence from blockcrane operators, because the operator did not have qualifications and certification in operating block cranes.

"Meanwhile, the person in charge of the loading and unloading process at Namlea Port is ignored and does not implement standard operating procedures (SOP) regarding the use of operator personnel who operate block cranes or loading and unloading processes at the sea port," he said.

The five suspects were charged with Article 107 and/or Article 99 paragraph (1) of Law Number 32 of 2009 concerning environmental protection and management, in conjunction with Article 22 of Government Regulation in Lieu of Law Number 2 of 2022 concerning job creation, and Government Regulation of the Republic of Indonesia Number 74 of 2001 concerning Management of B3, and Government Regulation of the Republic of Indonesia Number 22 of 2021 concerning the implementation of environmental protection and management in conjunction with Article 55 paragraph (1) 1e of the Criminal Code.

"The five suspects are threatened with imprisonment for a minimum of five years, a maximum of fifteen years and a fine of at least five billion rupiah and a maximum of fifteen billion rupiah," he said.

In addition to naming five suspects, the police also secured evidence of B3, such as SodiumTetraborateDdecahydrate, Sodium Hydroxy (NaOH), Carbon (C), Kalium Carbona (CaCO3), Calium Oksida (CaO), Asam Nitrat (HNO3), Hydrogen Peroxide (H2O2), Sodium Cyanide (NaCN), and Cyanide (CN).

With the appointment of the five suspects, it automatically dismissed all oblique accusations from various parties regarding the handling of the case of the fall of the B3 container which allegedly had an impact on pollution in the local marine waters.

"So far, many parties have accused us of keeping this case silent, even though we are silent, it does not mean that we are not working. But investigators continue to work to clearly uncover the case according to the evidence obtained, to the public," he said.

According to him, the police in every handling of a case, sooner or later in disclosing each case, depend on the evidence found, and it is not as easy as turning the palm of the hand.

"So every case handled, some are fast and slow to reveal or resolve. It all depends on the evidence found. Moreover, the cases handled are the attention of the Maluku Police Chief, so there is no silence as alleged by various parties," he said.
