KCIC On Alleged Conspiracy Of High-speed Rail Project Tender: We Are Not Involved

JAKARTA - PT Kereta Cepat Indonesia China (KCIC) has opened its voice regarding the results of the investigation by the Business Competition Supervisory Commission (KPPU) regarding the alleged conspiracy to tender the provider of train transportation services or Electric Multiple Units (EMU).

The case investigated by KPPU was the transportation of EMU from Tanjung Priok Port to Tegalluar Depot which was carried out internally by CRRC Sifang as part of the High-Speed Railway Contractor Consortium (HSRCC) consortium.

PT KCIC Corporate Secretary Eva Chairunisa emphasized that KCIC was not involved in the process of procuring land transportation service providers. This is because KCIC is in the position of recipient.

"This needs to be straightened out, that the KPPU investigation was carried out in the process of procuring facility transportation service providers, where KCIC as a service recipient did not participate in the process," Eva said via text message quoted on Tuesday, December 17.

The EMU transportation process itself will take place from September 2022 to June 2023 according to the schedule for EMU arrivals at Tanjung Priok Port. Eva said that during that time there were a total of 12 EMUs transported in several batches to the Tegalluar Depot.

Furthermore, Eva said that according to the Engineering, Procurement, and Construction (EPC) contract between KCIC and the HSRCC consortium, KCIC received EMU from CRRC manufacturer Sifang in a ready-to-operative condition and was certified by the authorized institution.

"So as recipients of services within our scope, we ensure that these facilities arrive at Tegalluar, so that if we look at the reported KPPU information, it is not KCIC," said Eva.

Eva added that KCIC is committed that all company activities in various aspects are carried out in accordance with the principles and governance of good companies.

"And KCIC respects the process carried out by KPPU related to the investigation," he said.

Previously, the Business Competition Supervisory Commission (KPPU) found an alleged tender conspiracy on the Jakarta-Bandung high-speed rail project, known as warehousing which involved a Chinese company, PT CRRC Sifang Indonesia.

Head of the Public Relations and Cooperation Bureau at the Secretariat General of KPPU Deswin Nur said investigators reported alleged violations (LDP) article 22 of Law Number 5 of 1999 related to Land Transportation Procurement for the Supply Unit (EMU) Supply Supply Supply in the Jakarta Project. "In his LDP, the investigator suspects that there has been a conspiracy in the supply of train units for the Jakarta-Bandung high-speed rail project," he said in an official statement, quoted Monday, December 16.

Deswin said this case came from a public report involving PT CRRC Sifang Indonesia as Reported I (which is also a tender committee) and PT Anugerah Logistik Aktindo (ALP) as Reported II.

Furthermore, Deswin said investigators explained various facts or findings that led to conspiracy, such as Reported I which did not have standard written regulations related to the procedures for selecting goods and/or services providers.

Then, Reported Reported I also did not accept and/or open and/or evaluate the bidding documents openly or transparently, and Reported I won tender participants who did not meet the qualification requirements.

"Investigators suspect that Reported I has discriminated against and restricted tender participants to win Reported II," he said.

Deswin explained that according to the KPPU investigator, the reported party or ALP did not deserve to be the winner of the tender, because it did not meet the required paid-in capital, which amounted to Rp. 10 billion, and did not have similar experience or work experience related to the specified object, and did not get the highest score or score in the tender.
