Kaleidoscope 2023: The Emergence Of Generative AI And The Steps Of World Countries In Regulating It

JAKARTA - Although artificial intelligence (AI) technology existed about a decade ago, however, AI's development looks very fast over the past year, following the emergence of a ChatGPT chatbot from OpenAI.

Since then, all technology companies around the world have started competing to create their best AI innovations, to the emergence of Generative AI or what is familiarly called Generative AI.

Launching from Rackspace, AI is a branch of artificial intelligence related to the creation and development of new materials. Sometimes referred to as Creative AI or Strong AI.

The salient difference between these two technologies is, if Traditional AI aims to perform special tasks based on predetermined rules and patterns, then AI Generates beyond these limitations and seeks to create entirely new data that resembles human-made content.

Along with the rapid development of AI today, many countries will and have started to make regulations related to AI's development, use, and ethics in their country, to minimize the risks created by AI.

Throughout 2023, the following is a list of countries around the world that have made regulations related to AI technology.

Australia

Australia is a country that currently has plans to make AI regulations. In November, Australian Competition Supervision (ACCC) called for new regulations as five tech giants, Amazon, Apple, Google, Meta and Microsoft continue their expansion of developing technologies such as AI Generative.

UK

On September 18, the UK Competition and Market Authority (CMA) established seven principles designed to force developers to be accountable, preventing giant tech companies (Big Tech) from binding AI technology on their platforms. This principle was proposed six weeks before Britain held a global AI safety summit.

China

Additionally, Chinese internet regulators announced draft measures to manage a generating AI service, in which they require service providers to submit security assessments to authorities before launching their AI products to the public.

EU

The European Union (EU) is one of the countries that is very fast as a pioneer in global AI regulations. Currently, the EU has reached an important stage in negotiations to implement the world's first AI regulations.

After several delays, an agreement was finally reached on December 7 to control the generating AI tool. This deal includes tools such as ChatGPT from OpenAI and Bard from Google, which have raised concerns over the misuse of technology.

France

France's CNIL privacy watchdog said in April it was investigating several complaints about the ChatGPT after its chat box was temporarily banned in Italy over alleged violations of privacy rules.

Japan

Currently, Japan is still in the stage of investigating possible AI-related violations. Therefore, Japan expects to impose regulations that may be similar to the US by the end of 2023.

Poland

Poland has not announced any legal action governing artificial intelligence. However, according to Antara, the Polish Personal Data Protection Agency (UODO) said it was investigating OpenAI over complaints that ChatGPT violated EU data protection laws.

G7

The digital minister G7 of developed countries said that the G7 should adopt risk-based regulations on artificial intelligence after a meeting to discuss AI technology on April 29-30 in Japan.

Spain

Spanish data protection agencies said in April that they were starting an initial investigation into potential data breaches by ChatGPT. They also asked the European Union's privacy regulatory agency to evaluate privacy concerns related to ChatGPT, the agency told Reuters in April.

United States

Senator Michael Bennet introduced a bill on April 27 that would create a team to look at US policies on artificial intelligence and identify the best way to reduce threats to privacy, civil liberties and legal proceedings.

Joe Biden's administration said in April it was seeking public comment on possible accountability measures for artificial intelligence systems.

Indonesia

Indonesia is one of the countries in Southeast Asia that is currently working on AI regulations through the Circular Letter of the Minister of Communication and Information on Artificial Intelligence Ethics, which is planned to be published this month.

On November 27, 2023, the Ministry of Communication and Information Technology held a Focus Group Discussion with several stakeholders to design SE according to what was needed and of course in accordance with applicable norms in Indonesia.

In addition, the government through the National Innovation Research Agency (BRIN) and the Collaboration of the Artificial Intelligence Industry (KORIKA) is making an Artificial Intelligence National Strategy (Stranas) to strengthen national competitiveness.
