The Aceh High Prosecutor's Office (Kejati) has stopped prosecuting two cases through restorative justice after the perpetrators and victims agreed to make peace. The two cases are related to abuse and domestic violence (KDRT)

Daily Executor of the Head of the Legal Information and Public Relations Section of the Aceh Attorney General's Office, Ali Rasab Lubis, in Banda Aceh, said that the termination of the prosecution of the two cases was after obtaining approval from the Deputy Attorney General for General Crimes at the Attorney General's Office.

"There were two cases whose prosecutions were terminated after Jampidum agreed. The two cases were handled by the Gayo Lues District Attorney and the Southeast Aceh District Attorney," said Ali Rasab, quoted by ANTARA, Monday, January 30.

The approval to terminate the prosecution of two cases through restorative justice was carried out virtually, followed by the Head of the Aceh High Prosecutor's Office Bambang Bachtiar, the Assistant for General Crimes at the Aceh High Prosecutor's Office, and the Head of the State Prosecutor's Office Gayo Lues and Southeast Aceh.

The two cases were with the suspect on behalf of Asmaini handled by the Gayo Lues District Attorney. The suspect was charged with Article 351 paragraph (1) of the Criminal Code regarding persecution.

Then the suspect on behalf of Hendra Tadarus in a domestic violence case handled by the Southeast Aceh District Attorney. The suspect Hendra Tadarus was charged with Article 44 paragraph (1) of Law Number 23 of 2004 concerning the Elimination of Domestic Violence

"The termination of the prosecution of the two cases in a restorative manner was carried out because the first two suspects committed a criminal act and the threat of a sentence of no more than five years," explained Ali Rasab.

In addition, the two suspects have made peace with the victim and admitted their mistakes and have apologized to the victim. Meanwhile, the victim has also forgiven the suspect and will not sue again.

"For the suspect, Asmaini has also paid compensation for the victim's medical fee of Rp. 9 million because as a result of his actions, the victim named Session Malika suffered a wound to the neck based on the doctor's post-mortem," said Ali Rasab.

He said the peace between the suspects and the victim was known to the families of the two parties and witnessed by community leaders in their environment. The suspect's peace with the victim received a positive response from the community

"Furthermore, Jampidum ordered the heads of state prosecutors to issue a letter determining the termination of prosecution based on restorative justice as a manifestation of legal certainty," he said.
