Corruption Bengkulu Hajj Dormitory, Former Director Of PT BKN Sentenced To 4.5 Years, Makelar 4 Years In Prison

BENGKULU - Bengkulu District Court (PN) sentenced former Branch Director of PT BKN, Suharyanto to a case of corruption in revitalization and construction of hajj dormitories for the 2020-2021 fiscal year.

For the defendant Panca, Brother Silalahi as a broker, he was sentenced to 4 years in prison with a fine of Rp. 200 million, subsidiary to six months in prison. "The defendant Suharyanto and the defendant Panca Brother Silalahi were proven and confirmed guilty in the articles of primer of the public prosecutor," said Chief Justice Fauzi Israh when reading the verdict against the two defendants in the Hajj dormitory corruption case at the Bengkulu District Court, Thursday, March 14, confiscated by Antara. In the verdict of the panel of judges, the defendant Suharyanto was also fined Rp. 200 million, subsidiary to six months in prison and additional penalties in the form of Rp. 399 million in Lieue Money (UP), provided that if it is not completed within one month after the court's decision, then the defendant's property will be confiscated according to the nominal UP and if it is not sufficient to be replaced by imprisonment for two years. Meanwhile, for the defendant Panca to be charged with a replacement fee of Rp. 25 million, provided that if it is not completed within one month after the court's decision, then the defendant's property will be confiscated according to the nominal UP. Meanwhile, the legal advisor for the defendant Suharyanto, Prima said, his party would examine the panel of judges's decision file before taking legal steps in the future.

Sebelumnya, Jaksa Penuntut Umum (JPU) Kejaksaan Tinggi (Kejati) Bengkulu, menuntut dua terdakwa yaitu Suharyanto enam tahun pidana penjara dan terdakwa Panca 5,5 tahun pidana penjara.Sebab, kedua terdakwa melanggar dakwaan primer Pasal 2 ayat (1) jo. Pasal 18 Undang-Undang Republik Indonesia Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan Undang-Undang Republik Indonesia Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang Republik Indonesia Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi.JPU Kejati Bengkulu Heru menerangkan, untuk terdakwa Suharyanto didenda Rp300 juta subsider enam bulan kurungan penjara dan pidana tambahan berupa UP Rp399 juta apabila tidak membayar uang pengganti makan akan diganti kurungan penjara empat tahun.Selanjutnya terdakwa Panca juga didenda sebesar Rp300 juta subsider enam bulan kurungan serta membayar uang pengganti sebesar Rp44 juta dan apabila tidak membayar uang pengganti maka akan diganti kurungan selama tiga tahun.Diketahui, berdasarkan hasil penghitungan kerugian negara oleh Badan Pengawasan Keuangan dan Pembangunan (BPKP) Perwakilan Bengkulu mencapai Rp1,28 miliar dan total pengembalian KN terakhir sebelum tersebut disidangkan sebesar Rp798 juta.Ditambah pengembalian KN oleh terdakwa Panca Saudara Silalahi Rp45 juta sehingga total Rp843 juta.
