KPK Ready To Appeal Edhy Prabowo Defendant Of Benur Bribery
JAKARTA - The Corruption Eradication Commission (KPK) is ready to face an appeal filed by former Maritime Affairs and Fisheries Minister Edhy Prabowo.
Acting KPK Spokesperson for Enforcement, Ali Fikri, said that his party would prepare a counter memorandum of appeal as a rebuttal to the arguments presented by Edhy's party.
"Regarding the legal action proposed by the defendant, we will prepare a counter memorandum of appeal as a rebuttal to the argument of the legal remedy in question," Ali told reporters, Friday, July 23.
He also said that his party would not appeal the decision that had been handed down by the Corruption Court. This was done after the KPK studied the results of the trial.
"After we studied, the analysis of the public prosecutor (JPU) in his claim has been taken over by the panel of judges in their consideration so that we do not file an appeal," said Ali.
Previously, Edhy Prabowo's lawyer Soesilo Ariwibowo said his party would appeal against the five-year prison sentence handed down by the Corruption Court (Tipikor) at the Central Jakarta District Court.
This application was made because his party objected to the judge's decision which assessed that Edhy had violated Article 12 letter a of the Anti-Corruption Law. According to Soesilo, the former Gerindra Party politician is more likely to be found guilty under Article 11 of the Anti-Corruption Law.
In the 11 Corruption Laws, it is stated that the minimum prison term is 1 year and the maximum is 5 years. Meanwhile, the fines imposed are a minimum of IDR 50 million and a maximum of IDR 250 million.
In this article, it is explained that the acceptance of gifts or promises given because of the power or authority related to his position, or according to the mind of the person who gave the gift or promise has something to do with his position.
This is different from Article 12 which states that acceptance is carried out to mobilize to do or not do something in their position that is contrary to their obligations
