Polda Responds To Anies' Desire To Ask Satpol PP To Investigate Actions For Prokes Violators
JAKARTA - Polda Metro Jaya has responded to the proposal from the Governor of DKI Jakarta, Anies Baswedan, who said that the Satpol PP was given the authority to become investigators in cases of violations of health protocols (prokes).
Head of Public Relations of Polda Metro Jaya Kombes Yusri Yunus said Satpol PP could be investigators but must have certification from the police.
"It must have a certification from the police and all the mechanisms must be clear as to what," said Kombes Yusri to reporters, Friday, July 23.
Moreover, according to him, investigators are divided into two, namely, investigators from the National Police and PPNS (Civil Servant Investigators). Where, Satpol PP is included in the category of civil servants.
Yusri continued, in the proposal, the Satpol PP only carried out an investigation related to the prokes rules. Because, the rules used as the basis are local regulations.
"They are enforcers, internally investigators enforce the rules, what are the rules? The regional regulations are related to regional regulations, not investigators like the police who can all do it. He enforces the rules in each regional regulation," said Yusri.
In addition, in its implementation the process of investigating violations of the process will be supervised and assisted by the police. The reason is the limited resources of the Satpol PP.
"If only Satpol PP believes they can't afford it, there are only 2 sub-district investigators, so they are assisted by the police to help lighten everything, so don't get the wrong perception, is Satpol PP an investigator, yes, he is a PPNS who chooses from the police a certification as an investigator," he said. Yusri.
"The police here are the supervisors, so there is a PPNS korwas together with several other PPNS agencies," he continued.
As previously reported, in the draft amendment to the regional regulation received by VOI, Anies slipped one article between Articles 28 and 29, namely Article 28A.
This article contains rules regarding the investigation of violators of the PPKM provisions. In addition to the article, Anies wants DKI State Civil Apparatus (ASN) such as the Satpol PP to have the authority as investigators.
This means that this investigator is authorized to receive reports, conduct examinations, ask for information and evidence, examine the identification of people suspected of violating the rules, take fingerprints, take pictures and provide the results of investigations to the police and district courts to determine criminal penalties.
Furthermore, Anies also added two articles between Articles 32 and 33, namely Articles 32A and 32B. This article adds a criminal threat.
He explained, if there are violators who repeat the act of not wearing a mask after being given social and administrative work sanctions, they will be sentenced to a maximum of three months in prison or a maximum fine of Rp. 500,000.
Furthermore, for business actors such as offices, industry, hotels, transportation, and restaurants who repeat acts of violating health protocols and have received a license revocation, they will be sentenced to a maximum imprisonment of three months or a maximum fine of IDR 50,000,000.
