Found Backdate For Signing MoU TWK KPK Employees, Ombudsman: This Is A Serious Deviation

JAKARTA - The Indonesian Ombudsman found serious irregularities in the procedure for implementing the National Insight Test (TWK) for employees of the Corruption Eradication Commission (KPK).

One of them was found that a memorandum of understanding (MoU) was made backdated several months before the implementation was carried out.

Ombudsman member Robert Na Endi Jaweng said the memorandum of understanding was made between the KPK and the State Civil Service Agency (BKN) which was the executor of the assessment.

"The memorandum of understanding for the procurement of goods and services through self-management between the Secretary General of the KPK and the Head of BKN was signed on April 8, 2021 and the self-management contract was signed on April 20, 2021. However, the date was set back on January 27, 2021," said Robert at a press conference to deliver the final results of the examination of employee complaints. KPK broadcast online, Wednesday, July 21.

"So the signature was in April but it was made three months back, namely January 27, 2021," he added.

Robert said the findings showed there were serious procedural irregularities. Moreover, TWK was held on March 9.

So, when the activity was held the memorandum of understanding and the self-management contract did not yet exist.

"This is a procedural deviation that makes us quite serious both in the governance of an institution and related to legal issues," said Robert.

Thus, one of the administrative defects found was the contract with a backward date and the implementation of the TWK which was not based on a memorandum of understanding.

"The Ombudsman is of the opinion that the KPK and BKN have deviated from procedures. One, make the contract date back. Second, carry out TWK activities on March 9, 2021 before the signing of the memorandum of understanding and self-management contract," he said

Previously reported, the mbudsman found maladministration in the process of implementing the National Insight Test Assessment (TWK) for employees of the Corruption Eradication Commission (KPK). This was conveyed by the Chairman of the Indonesian Ombudsman Mokhammad Najih on Wednesday, July 21.

"In general, we found maladministration from the results of the examination," Najih said at an online press conference broadcast on the Indonesian Ombudsman's YouTube account.

He explained that his institution focused on examining allegations of maladministration on the first three issues. First, in a series of policy formation processes, the process of transitioning the status of KPK employees to State Civil Apparatus (ASN).

Second, in the process of implementing a series of status transfers and finally at the stage of determining the results of the TWK assessment. "Three things that the ombudsman found potential for maladministration," he said.

Furthermore, these findings will be submitted to the KPK leadership, the Head of the State Civil Service Agency (BKN), and President Joko Widodo.

"We have submitted a letter of recommendation to the president so that the findings of maladministration found by the Ombudsman's examination can be followed up and further steps taken," said Najih.
