Not Only Imprisonment, Judges Also Revoke Edhy Prabowo's Political Rights
JAKARTA - The Corruption Court (Tipikor) did not only impose criminal sanctions and fines on the former Minister of Maritime Affairs and Fisheries, Edhy Prabowo.
In the decision in the bribery case for the export license for lobster seeds or fry, Edhy Prabowo was sentenced to revocation of the right to be elected in public (political) positions for three years.
"The defendant's additional punishment is in the form of revocation of the right to be elected in public office for 3 years after the defendant has finished serving his main sentence," said presiding judge Albertus Usada in a trial at the Corruption Court, Jakarta, Thursday, July 15.
The revocation of the right to be elected was based on the consideration that Edhy Prabowo had served as a minister and member of the Indonesian Parliament. Moreover, Edhy did not set a good example of the corruption he committed.
"Edhy Prabowo as the Minister of Maritime Affairs and Fisheries of the Republic of Indonesia who is the organizer of the state to be able to play an active role in carrying out his duties and obligations to set a good example by not committing corruption, collusion and nepotism," said Albertus.
"Thirdly, what happened was the opposite, the defendant actually injured his mandate by committing a criminal act of corruption so that this act not only supports the government's program in eradicating corruption, but also injures the mandate he carries as Minister of Maritime Affairs and Fisheries," continued two.
Therefore, the purpose of revocation of Edhy Prabowo's political rights is to protect the people's right to vote. Thus, Edhy as a public official has never behaved corruptly.
"So it is deemed necessary to revoke some of the defendant's political rights, namely additional punishment in the form of revocation of the right to be elected as a public office to the defendant for a certain period of time starting from the completion of the main sentence as stated in the verdict," said Albertus.
Meanwhile, Edhy Prabowo was sentenced to 5 years in prison for the bribery case for the license to export lobster seeds or fry. In addition, Edhy Prabowo was also sentenced to a fine of Rp. 400 million, a subsidiary of 6 months in prison.
In addition, Edhy Prabowo was required to pay compensation for the corruption he committed in the amount of Rp. 9.68 billion and US$77 thousand.
In this case, Edhy Prabowo violated Article 12 letter a of the Corruption Eradication Law in conjunction with Article 55 paragraph 1 1 of the Criminal Code in conjunction with Article 65 paragraph 1 of the Criminal Code.
