バドゥン病院のアルケス汚職の被告は3年の刑を宣告される

The Bali High Prosecutor's Office demanded three years in prison for Defendant I Ketut Budiarsa (65) in the alleged corruption case of medical equipment procurement funds (alkes), family planning and special vehicles at Badung Hospital which cost the state Rp6.2 billion.

The indictment against the defendant Ketut Budiarsa was read out alternately by Public Prosecutor Ni Luh Oka Ariani Adikarini and Ni Wayan Rismawati at the Denpasar Corruption Court (Tipikor), Bali, Thursday, May 11.

"The defendant I Ketut Budiarsa was sentenced to 3 (three) years in prison and a fine of Rp. 50 million, subsidiary 3 (three) months in prison," said prosecutor Oka Ariani before Denpasar District Court Judge Nyoman Wiguna.

In addition, the Public Prosecutor also demanded that the defendant Ketut Budiarsa pay compensation of Rp. 743,821,590.36 with the condition that if the defendant was unable to pay compensation after one month the verdict received a final decision, then the Prosecutor could confiscate his property and auction it off for the state.

However, if the defendant does not have sufficient assets to replace the state compensation money, then he can be replaced with imprisonment for 1 year and 6 months.

After the prosecutor read out his demands, Judge Nyoman Wiguna closed the trial and asked Defendant I Ketut Budiarsa to read out the plea or memorandum of defense next week.

At the previous trial it was revealed in the indictment that in 2013 the defendant Ketut Budiarsa together with witness I Ketut Sukartayasa, witness I Ketut Susila and witness Muhammad Yani Khanifudin (the three convicts in separate files) committed an unlawful act, namely having participated in compiling the Self Estimated Price (HPS) for the procurement of medical devices at the Badung Hospital.

In its provisions, the preparation of HPS should be the authority of the Commitment Making Officer (PPK).

Because of his actions, the HPS value becomes unreasonable, causing waste and leakage of state finances in the procurement of goods or services.

In that case, the defendant did not apply the principles of procurement of goods and services that were efficient, effective, transparent, open, competitive, fair or non-discriminatory, and accountable, and ignored procurement ethics with the aim of personal gain, class or other parties.

After calculating the actions of the defendant Ketut Budiarsa, he enriched Ni Ketut Widyawati in the amount of Rp. 10 million, I Wayan Bagiarta in the amount of Rp. 335,917,050, witness Muhammad Yani Khanifudin in the amount of Rp. 279,938,424, PT. Indoappliance gold in the amount of Rp. 65 million, IB Mudiartha in the amount of Rp. 68 million, I Made Susila in the amount of Rp. 1,273,629,325, Nino Adtya Maryono in the amount of Rp. 635,390,000. Also, enriching the defendant himself by Rp. 3,397,708,271.

For the actions of the defendant and other witnesses, it has harmed state finances or the state economy, in this case it is detrimental to state finances cq the Badung Regency Government amounting to Rp6,287,846,854.36.

The calculation is based on the audit report on the calculation of state financial losses No: SR-585/PW22/5/2016 dated 28 November 2016 made by the Bali Provincial Representative Financial and Development Supervisory Agency.

The indictment also revealed that the defendant Ketut Budiarsa played an active role in the process of establishing HPS as well as determining the implementation and contract value of the procurement of medical equipment, health, family planning, and special vehicles for the Badung district hospital for the 2013 fiscal year together with witness I Ketut Sukartayasa.
