JAKARTA - In a press conference of the Ministry of Communication and Information Technology (Kemenkominfo) on Wednesday, June 22, the spokesman for the Ministry of Communication and Information, Dedy Permadi announced the deadline for registration of private Electronic System Operators (PSE).

In accordance with the Circular Letter of the Minister of Communication and Information No. 3 of 2022 which was signed on June 14, 2022 concerning the Effective Date of Registration of Private Scope Electronic System Operators, the deadline for registration of private sector PSEs both domestic and foreign through the Risk-Based Electronic Integrated Business Licensing System is Online Single Submission Risk-Based Approach (OSS RBA), will expire on 20 July 2022.

"The determination of the time limit is in accordance with the mandate of the applicable laws and regulations, there are at least two references that we use," said Dedy.

The first legislation is Article 6 of Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions (PP 71/2019), and also Article 47 of the Regulation of the Minister of Communication and Information Technology Number 5 of 2020 concerning Electronic System Operators for Private Scope which has been amended through Regulation of the Minister of Communication and Information Number 10 of 2021.

In both regulations, there is an obligation for the operator of the private domestic and foreign electronic system to register no later than 6 (six) months since the PSE registration system is effective at the OSS RBA, namely from January 21, 2022.

"So if we count six months from January 21, 2022, then the deadline or deadline for registration is until July 20, 2022," he continued.

Dedy said that any private domestic or foreign PSE who did not register until the deadline set, the Ministry of Communication and Information would terminate access, after receiving a request from the Ministry or Institution authorized to supervise foreign private and domestic PSE according to the field. business as regulated by laws and regulations.

According to Dedy, there are six categories of private sector PSE that are required to register, based on PM Kominfo 5/2020. There are six of them, namely PSE which has a portal, site, or application on the network via the internet which is used to:

Provide, manage, and/or operate the offer and/or trade of goods and/or services, Provide, manage, and/or operate financial transaction services;, Delivery of paid digital materials or content through data networks either by downloading through portals or sites, sending by electronic mail, or through other applications to the Electronic System User's device Provide, manage, and/or operate communication services including but not limited to short messages, voice calls, video calls, electronic mail, and online conversations in the form of digital platforms, network and social media services Search engine services, Electronic Information provision services in the form of writing, sound, images, animations, music, videos, films, and games or a combination of some and/or all of them, and Processing of personal data for operational activities serving the public related to Electronic Transaction activities.
