JAKARTA - Chairman of the Indonesian Employers' Association (Apindo) Hariyadi Sukamdani said that his party had no intention of suing Government Regulation in Lieu of Law (Perppu) Number 2 of 2022 concerning Job Creation which was recently issued by the government.

Even so, he asked the government to involve employers in drafting government regulations (PP) as a follow-up rule.

"We have no plan to sue Perppu, but we ask the government to 'let's sit together', because in our view, this case is different from yesterday (Permenaker 18/2022)," Hariyadi said at a press conference in Jakarta, Tuesday, January 3.

According to him, Permenaker Number 18 of 2022 yesterday violated the previous rule, namely Law (UU) Number 36 of 2021.

Therefore, his party has filed a lawsuit which is still being processed by the Supreme Court (MA).

"Now it's different, because the Perppu talks about the law as a relatively high source of law, yes, so we try to see this perspective, we try to talk to the government and the DPR. Most importantly, we have provided notes," said Hariyadi.

"The case of the decision is different, let the public judge. We just want to convey an objective perspective," he added.

Not only that, said Hariyadi, his party will not sue the Job Creation Perppu because the regulation can accommodate Permenaker No. 18/2022.

According to him, involving public participation is the most important thing in drafting the law.

"We ask the government, parliament, come on, please. At least we can do (participation). Because if we take legal action, we become unproductive, how long will the legal process take?," he said.

Previously, Apindo highlighted two main cases that included the employment cluster in the Job Creation Perppu, namely the new formula for Minimum Wage (UM) and new rules regarding power transfer or outsourcing.

Regarding the UM formula contained in the Perppu, Apindo assessed that the calculation of UM, which combines economic growth variables, inflation, and certain indexes, will burden the business world.

Regarding outsourcing, Apindo feels that the imposition of restrictions in the Job Creation Perppu is an inappropriate step. This is because Indonesia needs very large employment opportunities, so that these restrictions will actually narrow the opportunity.
