Union Workers Highlight The Giving Of Severance Pay To Foreign Workers In Job Creation Perpu

JAKARTA - Labor unions that are members of the Confederation of Indonesian Workers Unions (KSPI) highlight several articles in government regulations in lieu of the Omnibus Law on the Job Creation Law. Starting from giving severance pay to foreign workers.

KSPI President Said Iqbal said several articles were rejected by labor unions. The first is the article on the minimum wage. In Perpu, the district/city minimum wage used the term can be determined by the governor.

"It is the same as the Job Creation Law. The legal language can be, it means there can be or not, depending on the Governor. The workers' proposal is, the editor is the Governor setting the district/city minimum wage," he said, in an official statement, Sunday, January 1.

In Perpu, said Iqbal, the calculation of the minimum wage for the amount of inflance variables, economic intercourse, and certain indexes. This is rejected by workers. Because in labor law, a certain index has never been known in determining the minimum wage.

"We suspect that certain indexes, such as those in Permenaker 18/2022, use index 0.1 to 0.3. Unions want no specific index," said Iqbal.

Then, continued Iqbal, the second note rejected by workers is outsourcing or power transfer. In the Job Creation Law, Articles 64, 65, and 66 are removed. In principle, overturn is allowed by Perppu, so there is no difference, even though there is room for dialogue.

In the Perpu, it is stated that the company can hand over some of the work implementation to other companies through a written transfer agreement. The government stipulates some of the implementation of work in Government Regulations.

Iqbal said that another thing that was in the spotlight was related to severance pay. In the Perpu there is no change. Workers ask for a return to Law Number 13 of 2003.

"Meanwhile, if the wages at the manager or directors level are considered too high, a 4 PTK limit can be made," he said.

Fourth, said Iqbal, what is in the spotlight is that the PKWT in the Job Creation Law is not limited to the correct period. In Perpu there are no changes.

"So the workers refuse this, because with this article work contracts can be made repeatedly," he said.

Fifth, continued Iqbal, related to termination of employment or layoffs there has been no change. This means that it is still the same as the Job Creation Law. Unions reject an easy system for layoffs to recruit easily.

Finally, foreign workers. Iqbal said, the contents are exactly the same as the Job Creation Law. Therefore, KSPI refused and asked for permission for foreign workers. If the permit has not been issued, it cannot work.

Then the criminal witness, said Iqbal, is also exactly the same as the Job Creation Law. Therefore, KSPI asked to return to Law Number 13 of 2003.

"Next is the arrangement of working time and exactly the same as the Job Creation Law. Likewise the arrangement of leave," explained Said Iqbal.

Iqbal said, what is also in the spotlight of the labor union is the regulation of the missing long leave. "We refuse. Likewise, the regulation of leave must return to Law No. 13 of 2003," he said.

Meanwhile, said Iqbal, the contents of the Job Creation Law regarding the article on the Land Bank, in the Perpu there are no changes. This means that the Job Creation Law remains in effect.

"We refuse, because it harms farmers and small people's land owners. Bank Tanah is oriented for the benefit of large corporations, oil palm plantations, and so on. The labor party and SPI ask that land banks be correlated with agrarian reform. The land bank in question is to be distributed to farmers," he said.

With this, said Iqbal, the labor union rejects the contents of the Job Creation Perpu. Iqbal said the step to be taken was to consider legal steps by conducting a judicial review.

"While the movement steps, there will be massive action," he explained.

In addition, said Iqbal, his party will also lobby. The labor union hopes to meet with President Joko Widodo (Jokowi) to provide input.

"About when the action and lawsuit against Perpu will be carried out, we will discuss it first with the elements in the Labor Party," he said.
