Welcoming The Decision Of The Administrative Court On Decreasing The DKI Jakarta Minimum Wage, Entrepreneurs: It's Not A Win-Loss Case, But Legal Certainty

JAKARTA - The State Administrative Court (PTUN) has granted an entrepreneur's lawsuit regarding the revision of the 2022 DKI Jakarta provincial minimum wage (UMP). In its decision, the PTUN asked DKI Jakarta Governor Anies Basweda to reduce the increase in the 2022 UMP.

The DPD Chairperson of the DKI Jakarta Indigenous Indonesian Entrepreneurs Association (HIPPI) Sarman Simanjorang said this decision was not a matter of losing or winning in the issue of provincial drinking wages. However, with this decision, it answers the basic questions of the business world to increase the DKI Jakarta UMP 2022.

The reason is, the government has issued PP Number 36 of 2021 which is a replacement for PP Number 78 of 2025 concerning Wages as the basis for local governments in determining the amount of the UMP.

"We as business actors welcome this PTUN decision because it is able to answer questions from the business world on the basis of the 2022 DKI Jakarta UMP increase. We view that this decision is not a matter of losing or winning, but of legal certainty and regulations," he said in Jakarta, Wednesday, July 13.

However, Sarman underlined the implementation of this decision. Moreover, he said, the 2022 DKI Jakarta UMP has been running for 6 months with an increase of 5.1 percent or Rp.4,641,854. That is, workers have received salaries in accordance with the increase that has been set.

"If it is suddenly lowered again, it will certainly be a debate within the company," he said.

Therefore, Sarman asked the DKI Jakarta Government through the Manpower Office to immediately respond to the PTUN's decision regarding its implementation in the field.

"There must be a scenario, so that it does not interfere with this already conducive industrial relationship," he said.

Sarman hopes that the Wage Council and the Regional Tripartite LKS Institution will jointly formulate how to implement the decision. Where the UMP DKI Jakarta 2022 returns according to the PP formula Number 36 of 2021 at 0.85 percent or Rp. 4,453,935.

On the other hand, Sarman said the efforts of the Governor of DKI Jakarta Anies Basweda to fight for the fate of workers in DKI Jakarta to get a better UMP increase certainly deserves appreciation.

"But in the end the PTUN canceled, of course we hope all parties can respect and accept it," he said.
