Kemenkop Targets Compilation Of The Draft Bill On Cooperatives To Be Completed In October 2022

JAKARTA - The Ministry of Cooperatives and SMEs (Kemenkop UKM) is targeting the preparation of the Cooperative Bill (RUU) and its completion in October 2022 so that it will be discussed in the DPR in 2023.

"We are targeting at least October 2022 to complete the Cooperative Bill to the DPR, so that next year it can be discussed in the DPR," said Deputy for Cooperatives at the Ministry of Cooperatives, Ahmad Zabadi, as quoted by ANTARA, Tuesday, June 21.

The draft bill that is being drafted by the Coordinating Ministry for Cooperatives is a replacement for the Cooperative Law Number 17 of 2012 considering that the regulation has been annulled by the Constitutional Court (MK).

Therefore, Law Number 25 of 1992 concerning Cooperatives is stated to remain valid for a while until a new law is enacted.

Along with the times, he continued, the 1992 Law did require improvements in order to remain relevant for efforts to empower cooperatives.

The existing Cooperative Bill has actually been in the DPR since the end of 2019 and should have been hammered. However, the regulation is still pending with a carry over status.

With the carry over status, the government actually only discusses things that have not been agreed upon.

However, the carry over status has expired, so the discussion must start from zero again.

"There are several things that have been discussed at that time, especially related to the supervisory function and the existence of a special LPS (Deposit Guarantee Agency) for cooperatives. Then there are rules for criminal sanctions for practices that are detrimental to cooperatives, the principles and values of cooperatives that have been included in the discussion. before," said Zabadi.

The revision of the bill will also cover the issue of cooperative bankruptcy, so it is hoped that this issue will be a concern when discussed by the DPR.

Likewise, the rules for the supervisory function of cooperatives need to be improved considering that there have been many problematic cooperatives.

"Of course, the institutional response for cooperatives, how to face the challenges of change, is also an important strategic environment for us to reformulate," he said.

Meanwhile, member of Commission VI DPR Nyoman Parta said the presence of the new Cooperative Bill would be an instrument of protection for Cooperatives and Micro, Small and Medium Enterprises (KUMKM) from all obstacles and threats that come.

"We want there to be a legacy on this Cooperative Law so that it becomes proof that the state is present for KUMKM through the law," said Nyoman.
