Agus Bentung Case Files Are Not Complete, The NTB Prosecutor's Office Calls The Number Of Victims Of Unsynchronous Harassment

Head of the West Nusa Tenggara High Prosecutor's Office (Kajati NTB) Enen Saribanon said the case file for sexual harassment with the suspect, a disabled person with the initials IWAS alias Agus Bentung was incomplete.

"So, from the receipt of the file on November 29, 2024, the results of the study stated that there was still a lack of evidence so we will provide what instructions must be completed," said Kajati NTB Enen Saribanon in Mataram as reported by ANTARA, Monday, December 9.

The instructions requested to complete the file are related to the victim's statement.

According to the prosecutor's office, the number of victims listed in the case file is not in accordance with what was revealed to be reporting to the Regional Disability Commission (KDD) of NTB Province.

"From the media, it was crowded that there was a complaint post against IWAS victims, it was approximately a dozen, but from the case file, one person has just reported it and two more people have become victims. So, there are only three, we follow this development, therefore, we provide instructions so that those who become victims can be in sync in the file," he said.

Furthermore, there was a request for this case to be reconstructed. Enen admitted that his party had received information from investigators that the reconstruction activity would take place on Tuesday (10/12).

"I received information that Tuesday (10/12) will be reconstructed and we have been notified to attend the activity," he said.

In addition, there is information related to psychologists. According to the research prosecutor, this psychological expert statement is important to strengthen the suspect's criminal act.

"That is what is requested to be completed immediately," said Enen.

Efrien explained that this clue was part of the coordination between the prosecutor's office and the police, considering that the handling of the Law on the Crime of Sexual Violence, the return of files on the new instructions from the investigating prosecutor did not apply.

"So, this guideline is part of our coordination with the police, it will be conveyed later, no later than 14 days after the file is transferred from the investigator to the research prosecutor," said Efrien.

In addition, there is other evidence in the form of the results of the victim's post-mortem, witnesses from the victim's colleague and the suspect and the owner of an inn that became the location of the execution.

Evidence is also strengthened by information from psychologists from the Indonesian Psychology Association (HIMPSI).

In the file, investigators also describe the modus operandi of the IWAS suspect as a person with the disability of the disabled in committing immoral acts against the victim. This mode is done by relying on verbal communication that can affect the victim's psychology.

Agus Bentung was charged under the suspicion of Article 6 letter c of Law Number 12 of 2022 concerning the Crime of Sexual Violence (TPKS).
