BPKS Issues Ultimatum For Land Users At Balohan Sabang Port, Leaves Before November 30

JAKARTA - The Sabang Area Concession Agency (BPKS) has issued an ultimatum for parties who are still using the land for the development of the Sabang Balohan Port, Aceh, to immediately vacate the location no later than November 30, 2023. "“BPKS has not been able to build a parking area which is part of the Balohan Sabang Port development program whose land has been acquired, because the land is still occupied by the parties," said Deputy for Spatial Planning and Development Engineering of the BPKS Sabang Azwar Husein in Banda Aceh, Monday. Azwar made this statement regarding the land acquisition for the development of the Balohan national ferry port in Sabang which already has permanent legal force but is currently still controlled by the parties. Azwar Husein, who was also accompanied by BPKS attorney Mohd Jully Fuady, explained that the Supreme Court (MA) had made a legal decision with the cassation decision number 1675 K / Pdt / 2021 against the community land dispute which was part of the construction site for the Balohan Sabang Port. BPKS carried out land acquisition of 1.37 hectares and buildings covering an area of 2,466,737 meters with a compensation value of Rp10.5 billion. In which there are 33 defendants and three plaintiffs on the land. BPKS sticks to and complies with applicable rules and norms by respecting the Supreme Court's decision, which has legal force, still grants the lawsuit of one party. BPKS has deposited compensation at the Sabang District Court as stipulated in the Supreme Court Regulation Number 3 of 2016 which was later amended by Supreme Court Regulation Number 2 of 2021 concerning Procedures for Submission of Objections and Compensation of Losses to the District Court, in land acquisition for development for the public interest it is the right of the parties won by Judek Yuris at the Supreme Court. “This means that land objects or land that become state-owned for development and the public interest in this case are BPKS. We urge the parties to respect and obey the norms and conditions, ” he said. He said that currently BPKS will soon manage the entire land, whose purpose is for the public interest, which is to provide comfort to all users of the Balohan Sabang port. "We have budgeted for the construction of a parking location, but because the land issue has not been completed so that this work cannot be carried out, we give until the end of November so that the land is immediately vacated," he said. BPKS also respects the agreement of the parties who were previously in dispute in court to make a peace agreement as an intention and effort to maintain the friendship between the parties. "“BPKS has been trying to help solely for humanity, but legally BPKS does not have the authority and capacity as one of the parties to get the contribution and the delegation to complete this peace," he said. His party appealed to the land that had permanent legal force to be vacated immediately so as not to interfere with the smooth development in the Balohan Sabang Port area.
