Chairman of the General Election Commission (KPU) Hasyim Asy'ari stated that his institution is preparing a draft amendment to KPU Regulation Number 10 of 2023 concerning Candidacy for Members of the DPR, Provincial DPRD, and Regency/City DPRD in accordance with the decision of the Supreme Court.

Hasyim said that the KPU was reviewing the results of the Supreme Court's decision to grant the judicial review submitted by the Association for Elections and Democracy (Perludem) and a number of other parties.

"We are currently reviewing, we are preparing a draft for changes to the KPU Regulation based on the Supreme Court's decision," said Hasyim at the office of the Government Goods/Services Procurement Policy Institute (LKPP), Jakarta, as reported by ANTARA, Monday, September 18.

When asked about whether or not the PKPU 10/2023 changes will affect the list of temporary candidates or ballots to be printed, Hasyim explained that the KPU would follow the Supreme Court's decision first.

"We will follow the decision of the Supreme Court first, yes," he said.

Previously, the Supreme Court granted the request for a judicial review of PKPU 10/2023 related to the calculation of the representation of prospective female legislative members.

The decision was decided on August 29, 2023 by the panel of judges chaired by Irfan Fachruddin with members of the Bright Bangun assembly and Yodi Martono Wahyunadi.

The petitioners sued Article 8 Paragraph (2) of PKPU 10/2023. They asked for a calculation of 30 percent of the number of female candidates to be rounded up if a fraction was found.

The article being sued reads: "In terms of a 30 percent calculation, the number of potential female candidates in each electoral district produces a fractional figure, then if the two decimal bins behind the coma are worth: (a) less than 50 (fifty), then the calculated results are rounded down; or (b) 50 or more, the calculated results are collected upwards."

According to the petitioner, the article contradicts Law Number 7 of 2017 concerning General Elections and Law Number 7 of 1984 concerning the Ratification of Conventions concerning the Elimination of All Forms of Discrimination Against Women (Convention on The Elimination of All Forms of Discrimination Against Women).
