The National Police Hand Over SPDP Denny Indrayana To The Attorney General's Office

JAKARTA - Investigators from the Directorate of Cyber Crime (Dittipidsiber) of the Criminal Investigation Unit of the National Police submitted a Notice of Investigation Commencement (SPDP) for the leakage of the Constitutional Mahakamah (MK) decision regarding the judicial review of the legislative election system with reported Denny Indrayana to the Attorney General's Office.

"Regarding the case of DI (Denny Indrayana, ed) currently on July 10, 2023, investigators have sent a notification letter for the start of the investigation (SPDP) to the Prosecutor's Office," said Head of the Public Information Bureau (Karopenmas) of the National Police Public Relations Division Brigadier General Ahmad Ramadhan as reported by ANTARA, Thursday, July 13.

Ramadhan said that with the delegation of the SPDP, the handling of cases of alleged leakage of the Constitutional Court's decision regarding the judicial review of the electoral system was already in the investigation stage.

Regarding when Denny Indrayana will be summoned to be examined as a witness, Ramadhan said that this stage was in the process considering that the SPDP had just been handed over as of July 10 yesterday.

"Yes (the call) will be processed, yes, on July 10 yesterday (the SPDP was handed over)," he said.

Separately, the Head of the Legal Information Center (Kapuspenkum) of the Attorney General's Office, Ketut Sumedana, in his statement said that he had received the SPDP from the Dittpidsiber Bareskrim Polri Investigator on behalf of the Twitter account user with the initials DI (Denny Indrayana).

The SPDP, said Ketut, was related to the alleged criminal act on purpose and without the right to disseminate information aimed at causing hatred or hostility to certain individuals and / or community groups based on ethnicity, religion, race and class (SARA) and / or by broadcasting false news or notification deliberately publishing disturbances among the public.

"As referred to in Article 45a paragraph (2) in conjunction with Article 28 paragraph (2) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning ITE and/or Article 14 paragraph (1) and (2) and/or Article 15 of Law Number 1 of 1946 concerning Criminal Law Regulations," said Sumedana.

The SPDP submission means that investigators inform the Prosecutor's Office that the investigation process of a case has begun, so that later, the Indonesian Attorney General's Office will appoint a research prosecutor (P-16) who will examine the completeness of the case file for evidence at trial.

Investigators from the Dittipidsiber Bareskrim Polri have raised the status of handling the Denny Indrayana case to the investigation stage at the end of last June.

The Head of the Criminal Investigation Unit of the National Police, which at that time was held by Komjen Agus Andrianto, Monday (26/6), said that the National Police would be proportional in investigating cases of alleged leaks of the Constitutional Court's (MK) decision regarding judicial tests of the legislative election system.

Agus, who is currently the Deputy Chief of Police, said that as soon as possible his party would ask for or examine witnesses and also experts related to the case.

Because, he continued, the case had caused unrest in the community. Thus, he directly ordered the Director of General Crimes (Dirtipidum) and Dittipidsiber to handle the two cases quickly.

"I ask the Director of General and Directors to handle this case quickly so that they can answer and answer the demands of the community so that this case is resolved immediately," said Agus.
