Prosecutors Demand PPK For BLUD Project Praya Adi Sasmita Hospital Prison 8.5 Years Fine Rp500 Million

The prosecutor asked the panel of judges to impose a sentence on the Commitment Making Officer (PPK) of the Regional Public Service Agency (BLUD) Project of the Praya Regional General Hospital (RSUD), Central Lombok Regency, Adi Sasmita for 8.5 years in prison. "Demanding that the panel of judges examining and adjudicating the case with the defendant Adi Sasmita impose a sentence of 8 years and 6 months in prison," said Bratha Hari Putra representing the team of public prosecutors reading out Adi Sasmita's demands at the Corruption Court at the Mataram District Court, Antara, Monday, June 26. To the defendant, the prosecutor also asked the panel of judges to impose a fine of Rp. 500 million, subsidiary to 6 months in prison. The prosecutor in charge stated that the defendant's actions as PPK had been proven to have violated Article 2 paragraph (1) in conjunction with Article 18 paragraph (1) letter b and Article 11 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code. The prosecutor set such charges with the consideration that the defendant did not support the government's efforts to eradicate corruption and the defendant's actions had harmed the community. "Other considerations are burdensome, there is no good faith in recovering the state financial losses that have been enjoyed by the defendant and during the trial the defendant gave complicated information," he said. For mitigating considerations, Bratha explained, the defendant had never served a sentence. In the description of the charges, the prosecutor declared Adi Sasmita as PPK along with two other defendants, namely the former Director of the Praya Hospital dr. Muzakir Langkir and the former treasurer of the Praya Baiq Prapningdiyah Asmarini Hospital jointly committed a criminal act of corruption that had caused state losses. Muzakir Langkir as the power user of the budget was also revealed in the fact that the trial had ordered the defendant Adi Sasmita to determine a number of provider companies that could obtain goods and services procurement projects from BLUD funds. With this description, the prosecutor stated state losses in the 2017-2020 BLUD fund management period worth IDR 883 million. This figure appears based on the results of an audit from the Central Lombok Inspectorate in the wet and dry food procurement project. In addition, there were allegations of bribery during the BLUD fund management period at Praya Hospital for the 2017 period. Regarding the state losses that arose, the prosecutor had fully charged the defendant Muzakir Langkir in accordance with the material demands of the prosecutor which took place on Friday (23/6).
