Bengkulu District Court Sentences 4 Years 2 Defendants Of Corruption In KPU Kaur Grant Funds

BENGKULU - The Bengkulu Corruption Court sentenced two defendants to 4 years in prison and a fine of Rp. 200 million for the corruption case in the General Election Commission (KPU) grant fund for Kaur Regency for the 2019-2020 budget with a total fund of Rp. 25 billion.

The verdict was handed down to two defendants, namely the former Secretary of the Kaur Regency KPU, namely Sunarsan and KPU Commitment Making Officer Kaur Ujang Nopizar.

"The two defendants were sentenced to four years in prison for being found guilty of committing a criminal act of corruption," said Chief Justice Dicky Wahyudi Susanto at the Bengkulu District Court (PN), Friday. He stated that Sunarsan and Ujang were found guilty. This is in accordance with the demands of the Public Prosecutor (JPU) of the Kaur District Attorney (Kejari), Article 2 Paragraph (1) in conjunction with Article 18 Paragraph (1) letter b, Paragraph (2), Paragraph (3) of the Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended by Law RI. Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption in conjunction with Article 55 paragraph (1) 1 of the Criminal Code. For the defendant Sunarsan a fine of Rp. 200 million with a subsidiary of three months and having to pay a replacement of Rp. 111 million with a note that if it is unable to pay for it, then the property can be confiscated. "The property is insufficient too, replaced with imprisonment for one year and six months," said Dicky. For the defendant Ujang Nopizar was also fined Rp. 200 million with a subsidiary of three months in prison and an additional replacement money of Rp. 78 million. However, if the defendant is unable to pay and the confiscated property is insufficient, replaced with imprisonment of one year and six months.

Diketahui, Sunarsan dituntut JPU dengan pidana penjara selama tujuh tahun dan denda Rp300 juta subsider tiga bulan kurungan penjara serta dikenakan pidana tambahan Uang Pengganti (UP) Rp462 juta subsider tiga tahun enam bulan.Untuk terdakwa Ujang Nopizar, JPU menuntut pidana penjara enam tahun enam bulan dan denda Rp300 juta subsider tiga bulan kurungan dan tambahan pidana uang pengganti sebesar Rp452 juta subsider tiga tahun tiga bulan penjara.Berdasarkan analisa yuridis JPU terhadap fakta selama persidangan bahwa kedua terdakwa bekerjasama dalam mengelola anggaran dana Hibah KPU Kaur senilai Rp25 miliar namun tidak sesuai dengan peraturan dan tidak dapat dipertanggungjawabkan sehingga menimbulkan kerugian negara Rp958 juta.
