Four Illegal Gold Miners In Madina Sentenced To A Year In Prison

MEDAN - The Public Prosecutor (JPU) from the Mandailing Natal District Attorney's Office has charged four defendants in the criminal case of illegal gold mining in Mandailing Natal (Madina), North Sumatra, with one year in prison each.

"Requested the panel of judges that each defendant be sentenced to one year in prison and a fine of IDR 10 million or a subsidiary confinement for one month," said Public Prosecutor Randi H Tambunan at the Medan District Court (PN) reported by ANTARA, Tuesday, April 4.

The four defendants namely WA as the manager of PT PEM's mining activities, SN the owner of the inherited land, and A as the foreman, and HL as the operator of heavy equipment (excavator).

According to the prosecutor, based on the facts of the trial, the four defendants were deemed to have fulfilled the elements of committing a crime Article 158 of the Republic of Indonesia Law (UU) No. 3 of 2020 concerning amendments to RI Law No. 4 of 2009 concerning mineral and coal mining in conjunction with Article 55 paragraph (1) to 1 Criminal Code.

"That is, ordering or participating in a mining business without a mining business permit (IUP), people's mining permit (IPR), or a special mining business permit (IUPK)," he said.

Randi said that the things that were aggravating against the four defendants were detrimental to the state, while the things that were mitigating them were being honest and polite in court.

The panel of judges chaired by Fauzul Hamdi said that they would continue the trial next week to hear pledoi from the four defendants and their legal counsel.

Previously, the four defendants were suspected of cultivating the inherited land belonging to the defendant SN which was located on the banks of the Batang Natal River in Jambur Village - Bangkelang Village, Batang Natal District, Mandailing Natal (Madina) Regency, North Sumatra Province (North Sumatra) as the location of PT's gold mining activities.
