Rafael Alun's Resignation From ASN Rejected, Kemenpan RB: If Proven Criminal, Dismissal With Respect

JAKARTA - The Ministry of State Apparatus Empowerment and Bureaucratic Reform (Kemenpan RB) confirmed that if found guilty, Rafael Alun Trisambodo's status from the status of the State Civil Apparatus (ASN) of the Ministry of Finance (Kemenkeu) was fired.

Rafael previously submitted his resignation as ASN after being removed from his position as General Head of Regional Office of DGT Jakarta II. However, his resignation application was rejected.

"Of course the process will be followed. The KPK or the Inspectorate will conduct an investigation," said Deputy for Bureaucratic Reform, Accountability of Apparatus, and Supervision of the Kemenpan RB Erwan Agus Purwanto in Semarang, Central Java, Friday, March 3, as reported by Antara.

If from the results of the examination there is evidence of a violation, especially a crime, he continued, the sanctions can reach the dishonorable dismissal.

"If there is clear evidence, there is evidence of violations of the criminal aspect, of course there will be sanctions and further processing will be carried out, including dishonorable dismissal," he said.

The Executive Secretary of the National Bureaucratic Reform Steering Committee, Prof. Eko Prasojo, added that Rafael's refusal to apply for resignation could be due to considerations of his legal implications.

"If he resigns, then it is approved, it means he is respectfully dismissed," said Agus.

If his resignation is rejected, said Eko, it means that Rafael can be examined. If there are findings of violations, such as abuse of authority, they can be dishonorably dismissed.

"What are the legal implications if he is dishonorably dismissed? He cannot retire. That's why Rafael's resignation was not approved," he said.

Previously, Deputy Minister of Finance (Wamenkeu) Suahasil Nazara said Rafael's resignation from ASN was rejected because he was still under investigation.

The rejection of the resignation was based on Government Regulation (PP) Number 11 of 2017 as the last one has been changed to Government Regulation Number 17 of 2020 and Regulation of the Head of the State Civil Service Agency (BKN) Number 3 of 2000.

He said the regulation contained that employees who were under investigation could not resign.

As is known, currently an investigation is being carried out onprivileged assets because he was suspected after the case of abuse and showing off his son's assets, Mario Dandy.

Rafael's resignation was made after Finance Minister Sri Mulyani removed the position of an employee of the Directorate General of Taxes to facilitate the examination of RAT's assets.

The resignation letter from RAT is dated February 24, 2023 and has been received by the Ministry of Finance on February 27, 2023 through the Directorate General of Taxes.

With the rejection of the resignation, Suahasil reminded that RAT is still the current ASN status.
