JAKARTA - The Legislation Body of the DPR RI approved that the Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation (Perppu Cipta Kerja) was passed into law during the next session.
Of the nine factions in the DPR, only two factions rejected it, namely the Democratic Party and the Prosperous Justice Party (PKS).
Member of the DPR Baleg from the Democratic Faction, Santoso, explained four reasons his party rejected the Job Creation Perppu as a product of the law.
First, the Democratic Faction assessed that the issuance of the Ciptaker Perppu was not in accordance with the Constitutional Court's decision which required the involvement of the community in the repair process.
"Secondly, the Job Creation Perppu does not fulfill the formality aspect and is also constitutionally flawed," Santoso said in his statement, Thursday, February 16.
Third, the Job Creation Perppu is considered not a solution to the legal and economic uncertainty in Indonesia as the government reason.
"It is proven that after the issuance of the community Perppu and the workers are still screaming and suing about the minimum wage scheme, outsourcing rules, PKWT, layoff rules, foreign workers, other leave schemes that require improvement are not only from formal, but in substance," continued Santoso.
Fourth, the Democratic Faction views that the Job Creation Perppu does not reflect the value of Pancasila, especially regarding social justice.
"Perppu Cipta Kerja, malah mengarah Indonesia ke arah ekonomi kapitalis dan neoliberalistik," tegas Santoso.
Meanwhile, the government, through the Coordinating Minister for the Economy Airlangga Hartarto, said that the Job Creation Perppu was urgently issued in order to answer the decision of the Constitutional Court (MK) to fill the legal vacuum in the Job Creation Law.
"The relevant parameters force according to the Constitutional Court's decision Number 138/PUU-VII/2009, namely the urgent need to solve legal problems quickly based on law," Airlangga said at a DPR Baleg meeting, Wednesday, February 15.

"Thirdly, the occurrence of a legal vacuum cannot be overcome by making laws in an ordinary procedure that takes a long time. Meanwhile, the urgent situation or need needs certainty to be resolved," he continued.
In addition, Airlangga explained, the issuance of the Perppu also answers to input from the public regarding the Job Creation Law.
"The limited changes made through the Job Creation Perppu are a response to input submitted by various groups of people, stakeholders. Including some trade unions or labor unions," he said.
