The Legislative Council Of The House Of Representatives Agrees That The Job Creation Perppu Will Be Brought To The Plenary Session To Be Ratified

AKARTA - The Legislation Body (Baleg) of the DPR has agreed to bring a Government Regulation in Lieu of the Job Creation Law (Perppu) to a plenary meeting. Furthermore, the Ciptaker Perppu will be ratified into a law product.

"Can the results of the discussion on the Bill on the Determination of Perppu Number 2 of 2022 concerning Job Creation into law be approved to proceed to second-degree talks?" said Deputy Chairman of the Legislation Body (Baleg) of the Indonesian House of Representatives M. Based on the discussion carried out by Baleg with the government and the DPD, as many as seven factions approved the Ciptaker Perppu to be ratified into law. Meanwhile, two factions, namely the Prosperous Justice Party (PKS) faction and the Democratic Faction, stated that they refused.

On the same occasion, Coordinating Minister for Economic Affairs Airlangga Hartarto said that the issuance of the Job Creation Perppu was a form of the government's efforts in anticipating the dynamics of the global economy which had a significant impact on job creation.

"This is also an effort to prevent before a much better crisis than the efforts taken after the crisis," he said.

The determination of the Job Creation Perppu, according to Airlangga, is also in line with Article 22 paragraph (2) of the 1945 Constitution and the parameter of the necessity of forcing the decision of the Constitutional Court Number 128/PUU-VII/2009, namely there is an urgent need to quickly resolve legal issues based on the law.

In addition, there is also no other required law so that there is a legal vacuum or inadequate current law.

"The occurrence of a legal vacuum cannot be overcome by making laws in an ordinary procedure that takes a long time, while the urgent situation needs certainty to be resolved," explained Airlangga.

Previously, President Joko Widodo had issued Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation. The regulation was issued after the Law on Job Creation was declared by the Constitutional Court conditionally unconstitutional in 2021 and must be corrected for the next two years.
