The panel of judges questioned the legal basis for the graduation criteria for new students (maba) for independent lanes to the Chancellor of Riau University (Unri) for the 2014-2022 period, Prof. Aras Mulyadi.

The question was conveyed by Chief Justice Lingga Setiawan at the follow-up trial of the 2022 University of Lampung (Unila) new student admission bribery case (PMB).

This was asked by the judge because witness Aras Mulyadi, who is also the Chairperson of the West Region State University (PTN) Implementing Committee, gave a statement that the chancellor has the authority to send students to independent channels.

"What is the legal basis for the chancellor to pass students. Every policy must be based on a legal umbrella," said the judge at the Tanjungkarang District Court, Bandarlampung, Thursday, February 9, as quoted by Antara.

He said that if the graduation of prospective students depends on the chancellor, it means that it is subjective. So there should be a legal umbrella underlying it.

"So the assessment is not subjective from the chancellor," he said.

He also emphasized that there is a need for clarity regarding the affirmation system and passing grade in the process of accepting new students.

"I am very disturbed when asked about affirmation, the answer is intended for campus families or lecturers, because everyone's children also want to go to college, including the judge's son, the journalist's son," he said.

Chairman of the West Region PMB Implementing Committee (PTN) Prof. Aras Mulyadi said that in the agreement made by the chancellor in the western region there was a quota of 30 percent of PMB affirmations whose graduation was handed over to the chancellor without losing quality control.

"For this affirmation, we adopted the process in the ministry, which was given to prospective students from Papua and underdeveloped, outermost, and frontier (3T) areas. Then in PKS, 30 percent affirmation authority was given to each rector, whether it was for local sons or sons and daughters of lecturers," he said.

He also said that every state university is given the right to determine the PMB quota in accordance with the laws and regulations, where from 100 percent of the quota is divided into two parts, namely 70 percent of graduation determined by the established system and 30 percent of others determined by the rectors of each PTN through affirmation channels.

"From the 100 percent quota, 70 percent of passes are determined by the system, while 30 percent is submitted to their respective rectors through affirmation channels. Likewise, the affirmation criteria are submitted to their respective rectors," he said.

Aras also said that the affirmation pathway, not determined or based on the value of the passing grade that must be met by prospective students, but according to the rules, it must also pay attention to the quality control of prospective students.

"The benchmark of the passing grade does not exist, so it is submitted to each rector," he said.

The KPK prosecutor presented six witnesses, namely former Unri Chancellor Prof. Aras Mulyadi, Director of the Higher Education Entrance Test Institute (LTMPT) Budi Prasetyo, lecturer at Sriwijaya University (Unsri), and Secretary of the BKS-PTN West Region Entis Sutisna.

The six witnesses were presented to testify against the three defendants, namely the former Chancellor of Unila Prof. Karomani, Deputy Chancellor I for the inactive Unila Academic Division Prof. Heryandi, and the inactive Unila Senate Chair Muhammad Basri.
