Supreme Court Justice Haswandi: The Decision Of The Embezzlement Case Of Rp. 106 Triliun Indosurya Has Not Had Permanent Legal Force

JAKARTA - Supreme Court Justice of the Indonesian Supreme Court's Civil Chamber, Haswandi, said that prosecutors could file an appeal against the West Jakarta District Court to release Henry Surya in an alleged criminal case of fraud and embezzlement with a total loss of Rp106 trillion.

"The decision does not yet have permanent legal force," said Haswandi in a statement received as quoted by ANTARA, Monday, February 6.

The former Director at the Directorate General of the General Court of Justice (BADILUM) of the Supreme Court (MA) added that public prosecutors (JPU), as generally as the public, must believe and provide opportunities for the Supreme Court to make improvements to mistakes or mistakes that may arise in the judiciary at the first level or appeal.

According to him, all efforts to criticize the Supreme Court, including stating that it is inappropriate to disobey the Supreme Court's decision.

"It is fitting to be independent, integrity, and the authority of judges, both at the first level and at the appeal or the Supreme Court Justice must also be guarded by all parties," he said.

Haswandi deeply regrets if there is a statement that attacks the dignity of the Supreme Court. Including statements or invitations to no longer respect the decisions of the Supreme Court.

"Moreover, there have been many decisions decided by the Supreme Court in order to maintain justice, legal certainty, and provide benefits to the Indonesian people," said Haswandi.

Previously, two high-ranking officials of the Indosurya Savings and Loan Cooperative (KSP) who were accused of cases of alleged fraud and embezzlement of funds were acquitted by the West Jakarta District Court (PN) judges.

The officials who were released were the Chairman of KSP Indosurya Henry Surya and the Finance Director of June Indria. This case cost 23 thousand people with a total loss of Rp106 trillion. June was sentenced to leave first on Wednesday, January 18 at the West Jakarta District Court.

The judge stated that he released June Indria from all lawsuits. June's rights were also restored. The trial was chaired by judge Kamaludin as chairman of the panel of judges and Praditia Dandindra and Flowerry Yulidas as members, respectively.

Then, Henry followed the release by the West Jakarta District Court on Tuesday, January 24. Henry is said to have been proven to have committed a civil act in this case.
