The DPR Expert From The PAN Faction Was Charged With Accepting Bribes For Managing The Arfak Mountains DAK In Papua

JAKARTA - The daily chairman of the DPD PAN Subang, Suherlan, was charged with accepting bribes of 33,500 US dollars or Rp4.51 billion in the alleged corruption case of receiving bribes for the management of the 2017 Revised State Budget Special Allocation Fund (DAK) and the 2018 State Budget for Arfak Mountains Regency, West Papua.

"Suherlan together with Rifa Surya and Sukiman received Rp4.51 billion and US$33,500 from Natan Pasomba and Saroy, in order to seek the Arfak Mountains Regency to get the budget allocation for the Revised State Budget for the 2017 fiscal year and the 2018 State Budget," said KPK prosecutor Taufiq Ibunugroho, at the Jakarta Corruption Court on Wednesday, January 4.

Sukiman is a member of Commission XI and a member of the 2014-2019 DPR-RI Budget Agency who has been sentenced to 6 years in prison, while Rifa Surya is the Head of the Planning Section for the Ministry of Finance's Special Allocation Fund II.

The bribe givers, namely the Acting Head of the Arfak Mountains District Spatial Planning/PUPR Public Works Service, Natan Pasomba, have also been sentenced to 1.5 years in prison, while Saroy's head is the Regent of the Arfak Mountains.

Initially, Rifa Surya had helped Arfak Mountains Regency get the budget allocation for the 2017 FY State Budget DAK, then Natan Pasomba asked Rifa for help in seeking additional DAK APBN-P TA budgets for 2017 and the 2018 State Budget.

First, related to the management of budget allocations sourced from the 2017 FY Revised State Budget. For example, Saroy submitted a 2017 APBNP DAK proposal worth IDR 105.06 billion, then Natan Pasomba asked Rifa for help in seeking the request. Rifa said that the application was approved for a "commitment fee" of 9 percent through the DPR Budget.

Furthermore, the defendant Suherlan, who is also an Expert Member of the DPR from the PAN and Rifa factions, met and agreed to distribute the "fee" for the additional management of the 2017 Arfak Mountains District DAK, which was agreed to be 9 percent of the DAK value with details of 1 percent for Suherlan, 1 percent for Rifa Surya, 1 percent for Natan Pasomba, and 6 percent for Sukiman as a member of the DPR.

The fee was then given in stages through the transfer of PT DIT's account, namely on July 25, 2017 worth IDR 300 million, on July 26, 2017 worth IDR 450 million, on 27 July 2017 amounting to IDR 160 million, on 28 July 2017 amounting to IDR 90 million, on 4 August 2017 amounting to IDR 100 million, on 9 August 2017 amounting to IDR 100 million, on 15 August 2017 amounting to IDR 26 million, on 18 August 2017 amounting to IDR 290 million, on 29 August 2017 amounting to IDR 300 million, on 6 September 2017 amounting to IDR 110 million, on 20 October 2017 amounting to IDR 500 million, on 24 November 2017 amounting to IDR 300 million.

Arfak Regency then received an additional DAK of IDR 49.915 billion on 27 July 2017.

In addition, Natan Pasomba also gave cash, namely in August 2017 amounting to 33,500 US dollars to Suherlan and Rifa Surya, in November 2017 amounting to Rp350 million to Rifa Surya, in November 2017 amounting to Rp200 million to Rifa Surya.

The whole money was then taken in stages by Suherlan and Rifa Surya from PT DIT and given directly to Sukiman in August-December 2017.

Second, the management of budget allocations sourced from the 2018 State Budget with the same amount of "commitment fee" is 9 percent. DAK, which fell for the Arfak Mountains in the 2018 State Budget, was IDR 79.774 billion.

"Fee" was given Rp. 300 million through the account of PT DIT on January 31, 2018 and on April 6, 2018, amounting to Rp. 700 million. Suherlan took the money on April 11, 2018 and handed it over directly to Sukiman at his home on April 13, 2018.

All the money received by Suherlan, Rifa Surya, and Sukiman either through transfer or directly was IDR 4.51 billion and 33,500 US dollars.

The money handed over to Sukiman was Rp2.65 billion and 22 thousand US dollars. Meanwhile, the money handed over to Natan Pasomba was 9,400 US dollars, while the remaining Rp1.86 billion and 2,100 US dollars were in control of Suherlan and Rifa Surya.

For his actions, Suherlan was charged under Article 12 letter a or Article 11 of Law Number 31 of 1999 as amended by Law no. 20 of 2001 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code in conjunction with Article 65 Paragraph (1) of the Criminal Code.
