JAKARTA - Attorney General Sanitiar Burhanuddin admitted that there are loopholes for restorative justice abuse. For this reason, he ensures that there is a monitoring system in its application.

This system is a step by the AGO so that restorative justice is not misused by unscrupulous prosecutors to become fields of profit or seek profit.

"It's true, when I wanted to sign this Perja, I was still hesitant because of the prosecutor's condition at that time. But with one determination I wanted to improve this situation," said Burhanuddin when met after the und of Justice' event, at the Smesco Building, South Jakarta.

According to Burhanuddin, there is a gap for abuse, because the case that previously needed to be resolved at trial was then decided by the prosecutor through restorative justice.

"This is a hope for these naughty prosecutors to do disgraceful things," he said, as quoted by Antara, Saturday, November 19.

To prevent this, said Burhanuddin, his party is monitoring both internal surveillance by the prosecutor's office and involving the active role of the community, including the media.

"We are trying to form a supervisory team in addition to the functionalities we have, namely the Deputy Attorney General for Supervision, we also have Task Force 53," he said.

Task Force 53, continued Burhanuddin, is the spearhead of the Indonesian Attorney General's Office to oversee prosecutors in the regions and throughout Indonesia.

"That (Satgas 53) is our form in order to supervise, do not let it happen, do not let abuse occur," he also said.

Since the Attorney General's Regulation (Perja) Number 15 of 2020 was signed, Burhanuddin said there have been more than 2,000 criminal cases resolved through restorative justice.

Burhanuddin emphasized that the restorative justice program echoed by his party to fix inequality in law enforcement which should be resolved outside the court, can be completed with a restorative justice approach.

"Our goal is not to reduce the contents of correctional institutions, but we answer to the public that the law is not sharp downwards blunt upwards," he said.

Other surveillance that is expected to come from the media reporting on abuse committed by prosecutors in the region.

The existence of a gap for prosecutors to take advantage of the restorative justice program was conveyed by the General Chairperson of the Indonesian Legal Aid Foundation (YLBHI) Muhammad Isnur.

"Hopefully restorative justice will be implemented appropriately, because it is feared that if you are not careful it will raise new questions, stop the case, mediate, if it is not controlled properly, it will be allowed by them. So there must be control, good regulations, good enthusiasm must be maintained," said Isnur.
