JAKARTA - Regarding the forced blackout of analog television broadcasts or Analog Switch Off, the management of MNC Group (representing RCTI, MNCTV, INews, GTV) stated that they had fulfilled the request. In a written statement, quoted on Friday, November 4, there were several official statements from the management of MNC Group, namely: 1. Given the request from the Coordinating Minister for Political, Legal and Security Affairs, Mr. Mahfud MD who asked for the Analog Switch Off which should have been valid Nationally, but in reality it is only limited to the Jabodetabek area, so we will carry out the request on Thursday, November 3, 2022 at 24.00 WIB. 2. In fact, we carried out this request even though to this day, at this hour and moment there has not been a single written letter received by the MNC Group regarding the revocation of an analog broadcast permit in the Jabodetabek area to support the Analog Switch Off program, so legally there is no obligation of us to implement the Analog Switch Off. 3. MNC Group realizes that the act of turning off broadcasts with an Analog system is very detrimental to the people of Jabodetabek, it is estimated that 60 percent of people in Jabodetabek can no longer enjoy television shows analogously in the Jabodetabek area, except by buying a Set Top Box or changing digital television or subscribing to parabolic tv but once again due to a request from the Coordinating Minister for Politics, Law and Security, Mr. Mahfud MD, we will obey and obey. 4. MNC Group views conflicting policies, especially when it comes to the decision of the Constitutional Court Number 91/PUU-XVIII/2020, in which one of the petitum states firmly: “ States to suspend all strategic and broad-impact actions/policies, and is not allowed to issue new implementing regulations related to Law Number 11 of 2020 concerning Job Creation ”. Meanwhile, MNC Group management continued, in fact there was a conflict or in other words dualism in its implementation, namely: a. Analog Switch Off is carried out only in the Jabodetabek area and is not carried out simultaneously nationally, proving that the decision of the Constitutional Court is true and is implicitly recognized by Kominfo. b. If this is considered to be the implementation of the Job Creation Act, then areas outside Jabodetabek should also apply Analog Switch Off, thus meaning that the Analog Switch Off decision is limited in the Jabodetabek area is not an order of the law, but is a decision of Kominfo alone. 5. Even though we remain obedient to the request of the Coordinating Minister for Political, Legal and Security Affairs, Mr. Mahfud MD, but for the sake of legal certainty and the interests of the wider community, we will file a civil and/or criminal charge according to applicable law.
