JAKARTA - The office of the insurance company PT Panin Dai-ichi Life was visited by its customers. The arrival of Molly Situwanda's customer, represented by his attorney, Johnny Situwanda, asked the company to pay a claim of IDR 270 million.

Molly Situwanda, represented by Johnny, had previously won the civil case for payment of this claim, from the district court (PN) level to the Supreme Court (MA) cassation.

"Today we came to meet the Director of PT Panin Dai-ichi Life but the person concerned was not willing to meet us. Even though in the company profile there was a president director and several directors, but none of the directors came to see us. they know that we are here to demand debts or obligations that Panin Dai-ichi Life has to fulfill," Johnny said, to reporters, Thursday, November 3.

Johnny revealed, on October 11, 2022, the Chairman of the West Jakarta District Court had summoned PT Panin Dai-ichi Life to attend to carry out the execution of paying the claim that his party had submitted. This is because they have won cases in the district court up to the Supreme Court.

"Then we submitted an execution and the West Jakarta District Court Chief gave a warning and promised that PT Panin Dai-ichi Life would take care of it on October 20, 2022, but it didn't happen. Until October 21, 2022, we filed for confiscation of assets," Johnny explained.

Johnny admitted that when he visited Panin Dai-ichi Life's office, his party was asked to make an appointment before meeting the company's leadership. He also emphasized that his visit to the office was not to beg for money, but to demand that Panin Dai-ichi Life obey the law in carrying out the court's decision.

"We have also written and subpoenaed the Financial Services Authority (OJK) but OJK has no teeth. OJK actually forwarded our letter to PT Panin Dai-ichi Life. Finally, PT Panin Dai-ichi Life replied to our letter. This is an incorrect procedure. We will prove the letters later. So no one can monitor this," said Johnny.

"Finally, we intervened ourselves, armed with a decree with permanent legal force and a promise from PT Panin Dai-ichi Life," he added.

His presence at the insurance company's office also wanted to prove whether PT Panin Dai-ichi Life had bad intentions or there was no money in the dispute. Johny said, this is because Panin Dai-ichi Life claims to be a big company that can pay claims of billions of rupiah, so the reason why they don't have money is an unreasonable excuse.

"But our claim, which was only IDR 270 million, did not want to be paid. PT Panin Dai-ichi Life through its attorney offered it to IDR 117 million. So I doubt whether you have money or don't want to pay? did we pay?" said Johnny.

PT Panin Dai-ichi Life itself, said Johnny, admitted that he was still reluctant to pay because he would still apply for a review (PK). This has been conveyed to the Chairman of the West Jakarta District Court.

"However, the chairman of the West Jakarta District Court, Judicial Review, has no effect on this execution," said Johnny.

As for after the Panin Dai-ichi Life office, Johnny's party then went to the West Jakarta District Court. This is done to inquire about the progress of the request for confiscation of assets whose documents have been previously submitted. Johnny hopes that Panin Dai-ichi Life's assets will be confiscated soon.
