JAKARTA - President Joko Widodo (Jokowi) said he would evaluate the performance of ministers in the government if they were disturbed by activities related to the presidential candidate market ahead of the 2024 General Election. "But if we see that it will be disturbing, it will be evaluated, whether it should be really long leave or not," said President Jokowi at Jiexpo Kemayoran, Jakarta, quoted from Antara, Wednesday, November 2. The President said the task as a minister must be prioritized even though the relevant ministers will contest the 2024 General Election. "Yes, the task as a minister must be prioritized," said the President. President Jokowi's statement was in response to a question regarding the decision of the Constitutional Court (MK) which stated that ministers or officials at the ministerial level do not need to resign if they run for presidential or vice presidential candidates. The decision is contained in the decision of case number 68/PUU-XX/2022. In that decision, the Constitutional Court accepted part of the lawsuit filed by the Garuda Party regarding Article 170 paragraph 1 of the Election Law. "Declaring the phrase'state officials' in Article 170 paragraph (1) of Law Number 7/2017 concerning elections... contradicts the 1945 Constitution of the Republic of Indonesia and does not have conditionally binding legal force," said Chief Justice of the Constitutional Court, Anwar Usman, in an online session, Monday, October 31. In its decision, the excluded position is to include a minister as a state official, there is no need to resign when running for a presidential or vice presidential candidate. "Including ministers and ministerial-level officials as long as ministers and ministerial-level officials get approval and leave permits from the president," he said. The Constitutional Court stated that there are eight categories of ministerial-level officials who still have to resign when running for president or vice president. The officials are the Chief, Deputy Chair, Deputy Chair, and Supreme Court Justices; Chair, Deputy Chair, and Judge at all judiciary bodies, except for ad hoc judges; as well as the Chair, Deputy Chair, and members of the Constitutional Court.
