Please Be Patient With The PDP Law, Presidential Decree And Deliberative Rules Still Prepared By The Government

JAKARTA - The government is preparing presidential regulations (perpres) and other derivative regulations for the implementation of Law Number 27 of 2022 concerning Personal Data Protection (PDP).

"There must be a Presidential Decree and the rules that must be made first, we are preparing," said Minister of Communication and Information Johnny G. Plate at the Presidential Palace, Jakarta, Thursday, October 21, as reported by Antara.

Through the Presidential Decree and derivative regulations of the PDP Law, the government will strengthen personal data protection. He also guaranteed that the government would hold public consultations in every drafting of derivative regulations of the PDP Law.

"Everything is there, don't go ahead. Later in the regulation there will be public consultations," said Johnny.

President Joko Widodo has officially signed the Personal Data Protection Act (UU PDP).

Based on a copy of the PDP Law issued on the Legal Documentation and Information Network of the Ministry of State Secretariat (JDIH Setneg), the legal product was recorded as Law Number 27 of 2022 concerning the Protection of Pribad Data signed by President Joko Widodo (Jokowi) on October 17, 2022.

The PDP Law applies to every person, public body and international organization that commits legal acts in the jurisdiction of the Republic of Indonesia (RI), and outside the jurisdiction of the Republic of Indonesia which has legal consequences in the territory of the Republic of Indonesia, and/or for the subject of personal data for Indonesian citizens outside the jurisdiction of the Republic of Indonesia.

"This law does not apply to the processing of Personal Data by individuals in personal or household activities," wrote Article 2 paragraph 2 of the Law.

In the PDP Law, there are also sanctions arrangements for violators of personal data protection. The sanctions are in the form of written warnings, temporary suspension of personal data processing activities, deletion or destruction of personal data, and/or administrative fines.

The PDP Law also regulates institutions that will provide personal data protection. Provisions regarding this institution will be regulated in a presidential regulation.

"The institutions as referred to are determined by the President," wrote Article 58 paragraph 3 of the PDP Law.
