JAKARTA - The ban on bringing pet dogs to Motor Vehicle Free Day (HBKB) and Car Free Day (CFD) by the DKI Jakarta Provincial Government continues to be opposed by the Chairman of the Jakarta City Citizens Forum (Fakta) Azas Tigor Nainggolan.

The prohibition on bringing animals to the CFD is regulated in the Decree (SK) of the Jakarta Kadishub No: e-0077 of 2022 concerning Technical Instructions for the Implementation of HKB in Jakarta which will be issued on June 22, 2022.

Azas Tigor assessed that the ban on the SK Kadishub was misguided and legally flawed because the SK Kadishub was not included in Indonesia's national law source.

In the decree, Kadishub referred to seven legal bases to develop Technical Instructions for the Implementation of HKB, one of which is Law (UU) Number 22 of 2009 concerning Road Traffic and Transportation.

Another legal basis is the Regional Regulation (Perda) of the Special Capital City of Jakarta Number 2 of 2005 concerning Air Pollution Control, and the Special Regional Regulation of the capital city of Jakarta No. 5 of 2014 concerning Transportation.

The technical instructions also refer to Regional Regulation No. 8 of 2007 concerning Public Order, Governor Regulation (Pergub) No. 12 of 2016 concerning the Implementation of HKB, Governor's Decree No. 545 of 2016 concerning the Determination of HBKB Locations, and Governor's Decree No. 509 Tahn 2016 concerning the HBKB Working Team.

"Not a single of the seven regulations has mandated the SK Kadishub to prohibit bringing pets to HBKB or CFD activities," said Azas Tigor in his statement, Wednesday, October 12.

"The SD Kadishub is not a rule of law, so it cannot be implemented, let alone make a prohibition to the public. Until now there is no legal regulation prohibiting bringing dogs or pets to HKB activities," he said.

Azas Tigor requested that the ban on bringing dogs or pets to HBKB activities be lifted, because they have no legal basis.

"Revocation of the ban must be carried out so that there is legal certainty and does not damage the legal order and arbitrarily make a prohibition. What should be made is the regulation or responsibility of the community if they bring other dogs or pets to the HBKB area," he concluded.
