MATARAM - The panel of judges at the Mataram Corruption District Court, West Nusa Tenggara (NTB), sentenced Nugroho to acquittal. Nugroho is a Commitment Making Officer (PPK) for the Arrangement and Reduction of the Labuhan Hajj Pier, East Lombok Regency. "Declaring that the defendant Nugroho is not proven guilty as in the indictment of the public prosecutor, both in the primary and subsidiary charges," said Chief Justice Kadek Dedy Arcana reading the verdict at the Mataram Corruption District Court, Antara, Wednesday, September 21. By stating this decision, the judge acquitted the defendant Nugroho from all charges by the public prosecutor. The judge in the verdict of the defendant Nugroho also ordered the public prosecutor to release the defendant from custody. In addition, the judge to Bank BNI Bandung Main Branch as the underwriter for the 2016 project advance ordered to disburse the project's advance deposit of Rp. 6.7 billion and to be then handed over to the East Lombok Regency Regional Treasury (Kasda). This value is in accordance with the disbursement of 20 percent of the project budget which is considered by the judge to be compensation for state losses. Previously, the public prosecutor demanded that the judge impose an 8-year prison sentence on the defendant Nugroho. The public prosecutor charged such a sentence by stating that the defendant's actions had fulfilled the primary indictment of Article 2 paragraph 1 Juncto Article 18 of Law No. 20/2001 on Amendments to Law No. 31/1999 on the Eradication of Criminal Acts of Corruption. According to the public prosecutor, the act of disbursing the advance amounting to 20 percent or Rp7.6 billion was not in accordance with the procedure and was against the law. The defendant was deemed not to be careful in the process of disbursing advance payments, causing state losses. On that basis, the panel of judges believes that PT. Guna Karya Nusantara (GKN) as the executor of a project that has received a down payment flow must be responsible for the loss to the country. "Thus, the evidence was returned to the public prosecutor to be developed into other cases," said Dedy Arcana. The development is related to the role of Taufik Ramdhani, the Managing Director of the PT Project. GKN who is also a suspect in this case. However, Taufik's whereabouts are not yet known until the prosecutor stated that he was on the wanted list (DPO). Regarding the acquittal of the defendant Nugroho, Head of the Special Crimes Section of the East Lombok Kejari M. Isa Ansyori stated that his party would coordinate with the leadership. "We first coordinate this decision with the leadership to determine further legal steps to the level of cassation," said Isa.
