JAKARTA - Member of Commission III of the DPR Habiburokhman assessed that the decision by the Police Code of Ethics (KKEP) to dismiss Inspector General Ferdy Sambo with disrespect was correct.

The decision to dishonorably discharge (PTDH), according to him, is a consequence that Inspector General Ferdy Sambo must accept after taking the lives of his own subordinates.

"The verdict is correct. Because this is a serious violation and has caused the loss of people's lives," Habiburokhman told reporters, Friday, August 26.

According to this member of the Gerindra faction, the code of ethics decision was aggravated because Ferdy Sambo tried to eliminate the evidence at the crime scene. Inspector General Ferdy Sambo called Habiburokhman also made a scenario in the premeditated murder of Brigadier J.

"What is even more burdensome is the effort to eliminate evidence by involving many members of the National Police," said the deputy chairman of the DPR MKD.

According to him, Ferdy Sambo's appeal would be in vain. Because he said, there was no longer any mitigating reason in the case of Ferdy Sambo.

"I think it's useless for him (Ferdy Sambo) to appeal, I don't see any mitigating reasons for that (his case, ed)," said Habiburokhman.

As previously reported, the suspect in the premeditated murder of Brigadier Yosua Hutabarat or Brigadier J, Ferdy Sambo, filed an appeal regarding the decision of the ethics trial which dismissed him dishonorably from the Police.

The appeal was conveyed by Ferdy after the decision on his dismissal was read by the Professional Code of Ethics Commission (KKEP) at the TNCC building at the South Jakarta Police Headquarters, Friday, August 26, early in the morning.

"Please allow the Chairperson of KKEP, how do we convey it in the trial process, we acknowledge all our actions and regret all the actions we have done to the Polri institution," said Sambo.

"But we ask for permission in accordance with Article 69 of PP No. 72 of 2022, allow us to file an appeal," he continued.

Final Appeal Decision, No PK

Meanwhile, the National Police confirmed that the appeal decision regarding Inspector General Ferdy Sambo would be final. There are no other legal remedies for the special appeal decision related to Ferdy Sambo.

The Head of the Public Relations Division of the National Police, Inspector General Dedi Prasetyo, explained that the National Police would not enforce the provisions of the Judicial Review (PK) contained in the Indonesian National Police Regulation (Perpol) Number 7 of 2022 concerning the Professional Code of Ethics and the Police Code of Ethics Commission in the case of Inspector General Ferdy Sambo.

In Perpol Number 7 of 2022, it is regulated that members of the National Police who are found to be proven to have violated the code of ethics can apply for a Judicial Review (PK) as stated in Article 83.

"Especially for Inspector General FS, the appeal is a final and binding decision," said Inspector General Dedi Prasetyo at a press conference at the National Police Headquarters, Friday, August 26 at dawn.

This means that, with the non-applicability of the rule, then the only legal remedy that can be taken by Ferdy Sambo is an appeal.

Ferdy Sambo can no longer take other legal steps such as a PK if he is not satisfied with the results of the appeal decision.

"So the appeal decision is final and binding. There is no longer any legal action," said Dedi.
