JAKARTA - Head of Construction Division VI PT Adhi Karya (Persero) for the 2011-2014 period, Dono Purwoko, was sentenced to 5 years in prison for corruption in the construction of the North Sulawesi Institute of Domestic Administration (IPDN) campus building in the 2011 fiscal year. This corruption case cost the state Rp19. 749 billion.

"The trial, stated that the defendant Dono Purwoko has been proven legally and convincingly guilty of committing a criminal act of corruption together as in the first indictment of the public prosecutor," said the panel of judges chaired by Eko Aryanto at the Jakarta Corruption Court (Tipikor), as reported by ANTARA, Thursday. , August 11th.

Chief Judge Eko Aryanto continued, "He sentenced the defendant Dono Purwoko to a prison term of 5 years and a fine of Rp. 500 million with the condition that if the fine is not paid, it will be replaced with imprisonment for 6 months."

The verdict is higher than the demands of the KPK Public Prosecutor (JPU) who requested that Dono Purwoko be sentenced to prison for 4 years plus a fine of IDR 500 million, subsidiary of 6 months in prison.

Dono was found guilty of committing the first alternative charge, namely Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 jo. Article 55 paragraph (1) 1 of the Criminal Code.

The panel of judges then stated aggravating things, including, among others, the defendant's actions did not support the government's program in an effort to eradicate corruption, the defendant's actions hurt the trust of the government and the community in general in the context of building the IPDN campus, and the defendant did not speak up in court and did not admit his deeds.

"The mitigating factors are that the defendant was polite and cooperative at the trial and the defendant has never been convicted," the judge added.

Dono's actions, according to the judge, enriched another person, namely Dudy Jocom as the official commitment maker at the Secretariat General Work Unit of the Ministry of Home Affairs (Kemendagri) in the 2011 budget year amounting to Rp3.5 billion.

Next is planning consultant PT Bita Enercon Engineering Torret Koesbiantoro for IDR 275 million, construction management consultant for PT Artefak Arkindo Djoko Santoso for IDR 150 million, and corporate PT Adhi Karya for IDR 15,824 billion.

It is known that the budget ceiling for the IPDN Minahasa campus building in North Sulawesi for the 2011 fiscal year is Rp. 127.834 billion. After PT Adhi Karya was declared to have passed the pre-qualification stage in June 2011, the company's marketing staff, Ari Prijo Widagdo, met with representatives of PT Waskita Karya and PT Hutama Karya.

During the meeting, it was agreed that PT Adhi Karya would work on the IPDN campus in North Sulawesi, PT Waskita Karya for the IPDN campus in Gowa, South Sulawesi, and PT Hutama Karya would work on Agam, West Sumatra and Rokan Hilir, Riau. Next, a bidding document is made as a companion company.

PT Adhi Karya was later determined as the winner of the tender with an offer value of Rp124.191 billion by the then Minister of Home Affairs Gamawan Fauzi on September 13, 2011.

Furthermore, Dono replaced the core team personnel without written approval, transferred the work to another party (subcontractor) without written permission from the commitment making official (PPK), submitted an application for payment of work that was not in accordance with the physical performance of the work and the results of the physical work did not meet the volume and specifications of the contract.

Dono also agreed to provide commitment fees to related parties of Rp3.5 billion for Dudy Jocom, Rp275 million for Torret Koesbiantor, and Rp150 million for Djoko Santoso.

PT Adhi Karya then received a total payment of IDR 125.191 billion which after deducting taxes the total net payment was IDR 109.514 billion, while the total cost used by PT Adhi Karya for IPD Sulut FY 2011 was IDR 89.764 billion so that the money amounted to IDR 19.749 billion. cannot be accounted for by its use.
